It's your fellow AMT's that have conducted the card drives to bring
AMFA here to AA.

If there is a chance that we the mechanics of AA can file new cards
to petition the NMB to conduct a vote, as 700UW has pointed out to us since we
don't know all he does. Since he was an IAM team negotiations member, during his time as a stock clerk. IF and when the DOJ decides on our fate merge or not we will not be able to file until 1 yr.

If we don't merge we the mechanics of AA can gather cards with out having to worry about the IAM mechanics at USAirways. Lets hope that it won't take a yr to get the cards this time either.

My guess is it was a TWU/ibt block on AMFA at the start, but the ibt flipped the script on the TWU, and then got caught forging cards.

Remember how in the beginning of the campaign the ibt wouldn't say a negative thing about the TWU and vice versa?

Then suddenly the wheels fell off that wagon and the fur began to fly, till finally they pull out to avoid the outcome of the investigation/lack of showing sufficient interest.

Can't say I've ever heard AMFA wasn't interested in representing us. Seems like your comments intend to throw kerosene on the fire.Problem is those comments along with ridiculous conspiracy theories make us look stupid. Maybe we're chasing away the opportunity for a quality organization to represent us.The real question needs be, why aren't we interested? This should have been a slam dunk six months ago. Too much apathy and too many fence sitters that can't decide how to stand for something. Stand for something or you'll fall for anything. Anybody but the TWBoo. All those teamster card signers should realize how close they came to the latter.

You are in denial. Teamster card signers allowed this debacle to have played out. Maybe it's all a part of the process, as long as we learn from the mistakes.

My understanding is that there would have to been an election to invoke the 1 year bar. The teamsters withdrew which does not qualify to invoke the one year ban. AMFA should be ok to file this year

I'm sure that will be an easy conclusion. IBT's petition was accepted, and then withdrawn. They're out for the count.

I'm less clear as to *if* AMFA's petition was rejected -- did they fail to deliver enough cards, or did they just not make a filing deadline to be included in the IBT's election?...

Either way, there's an out clause for unusual circumstances, and certainly you can argue that having another union's false start is unusual...

Except in unusual or extraordinary circumstances, the National Mediation Board will not accept an application for investigation of a representation dispute among employees of a carrier:

• For a period of two (2) years from the date of a certification covering the same craft or class of employees on the same carrier, and
• For a period of one (1) year from the date on which:
  1. The Board dismissed a docketed application after having conducted an election among the same craft or class of employees on the same carrier and less than a majority of valid ballots cast were for representation; or
  2. The Board dismissed a docketed application covering the same craft or class of employees on the same carrier because no dispute existed as defined in § 1206.2 of these rules; or

One year ban based on a filing that was withdrawn? Is that what the law says? That if there is a filing with no ruling because it was withdrawn, in other words no ruling from the NMB, that there is a one year ban on any other filings? That does not make sense. I think you are wrong.

NEWS FLASH: The Teamsters did create turmoil when they stepped in to help the TWU divert the drive away from the AMFA. For the TWU it is mission accomplished.
I believe this is the first time a union rescinded its application for a representational election. Of all unions to do so you would think the Teamsters would go all the way as long as there is money to line their pockets with. Corruption should be more of a reason to withdraw.
