The point, which as usual you missed is that any contract can be changed either by mutual agreement or via litigation. Usually in a contract dispute the side with the best attorney and deepest pockets will prevail. This is one reason we see most disputes settled out of court.

The bottom line is that West AND East agreed to binding arbitration. One side feels that the arbitration was unfair and have file multiple lawsuits seeking redress. To date things have not gone well for USAPA and this latest action by US in a way serves as proof of that fact. If USAPA was winning or expected to prevail then I don't think you'd see the request for injunction from US.

If USAPA loses the LOA93 case and US is granted an injunction the union is toast. This is a way to high stakes game for me as US could easily cease to exist a year from now.

IMO, USAPA is playing a very dangerous game of poker without many high cards and now their bluff has been called.

Well then, the east should have tried to sue to overturn the binding arbitration, instead of inventing a new union to get around it. West and east and the company agreed to binding arbitration, 3 parties. 2 of them honor it, one doesn't, too bad, that's like betting on your poker hand and trying to take the money back when you didn't have the hand you thought you had.

RLA rules may have made what you suggest impossible. RLA and airline rule/laws are arcane at best. IIRC they lost a DFR lawsuit against ALPA which I think forced them to create a separate union in order to pursue redress. Morally you argument holds a great deal of water. In the real world however it means that people do what's in their best interest and to Hell with what's right. It's part of our sense of entitlement.

You could make the argument that they are already limping from a few shots in the foot!

There is a brand new Arizona law that allows companies to sue unions for slander and libel for making false statements as part of a union action. I wonder if they lose this fight then that add becomes a false statement and sets up USAPA for yet another suit?

Care to comment on how the instructions below from an "on board" pilot are "safety related"?

we must make every effort to arrive at least 16 minutes late most of the time,and use the FDML to enter ALL discrepancies, no matter how small they may seem. Carry nothing back to base. Taxi at 7kts at all times so all can see how many people are onboard. Fly 4000 feet below flight planned altitude and and at speed equal to cost index 0. The on time arrivals are very important to management. We must bring the number below 70% despite those company pilots out there (PHX).

Thank you for being on board, use the term in your ATC and ramp communications. Peer pressure is an important aspect of our effort.
You represent the strongest among us. It is up to you to bring the others on board and tell them what is expected of them. We are monitoring the on time performance of our individual crews, but we will gladly accept nominations for “company pilot of the week”. Please email names to captainsonboard@aol.com. We will make sure that all of our pilots know who is not strong enough to walk the walk.
These are serious times and this no place for pansies. There is a lot at stake and we all are counting on your full participation.

Good Question. I'm thinking the Railway Labor Act may trump the AZ law, but one never knows.
 
Federal law always does.

AZ is a RTW state but it doesn't apply to pilots as we operate under federal law.
