Temporary Injunction against USAPA filed today

Doug Parker said, "The Company has overwhelming evidence indicating that this slowdown campaign is being waged in our East operation only, while our West flights continue to operate normally." I can't wait to see USAPA spin this. Lee Seham is going to get paid a lot of money this weekend.

With USAPA's budget showing a $250,000 deficit, new NAC staffing increasing FPL by about $200,000 per year, no money budgeted for the Status Quo Lawsuit and the Company's Injunction, will USAPA cut services or raise dues on the highest dues/assessment paying pilots in the entire United States?

And, I just read where Lee Seham advsied Cleary not to go down the slowdown campaign. Al Hemmenway warned Cleary. Too bad Cleary did not listen.

Once the court issues its injunction USAPA will be dead in the water. From then on any variance from historical operations, on anything, will almost certainly be a violation of the injunction. Parties who violate an injunction face civil or criminal contempt of court proceedings and may be ordered to pay damages or sanctions for failing to follow the court's order.

If USAPA and their slow down zealots commits a single act against the company not only can they be termianted from employment, but they may as well have committed suicide because they or the union can be ordered to pay fines or damages.

Under the RLA this is child's play for management. USAPA now could have damages to pay, although I believe the company will spare the pilots because Doug Parker said, "It is important you know that this lawsuit is aimed at USAPA and its leadership, not the thousands of dedicated airmen and women who – despite this political sideshow – operate their flights safely, on time and with the highest level of professionalism."

In my opinion, management is going to be watching every pilot on every flight and it behoves pilots to efficiently operate your aircraft and maybe management will show some lenancy.

With the hearings in CLT at least many US Airways employees will be able to watch the show, which could break USAPA's back.

I wish you had STAYED fired.

Um........yes?

Former US Airways worker sentenced to 2 years in prison for theft

By Pittsburgh Tribune-Review

Friday, July 29, 2011
A federal judge today sentenced a Beaver County man to two years in prison for stealing more than a half-million dollars worth of property from US Airways while he worked for the airline between 2004 and 2009.
Ronald Aikens, 53, of Center pleaded guilty in March to taking the equipment, including 43 Telex 750 headsets, and selling them on eBay.
U.S. District Judge Arthur Schwab also sentenced Aikens to three years of probation and ordered him to pay about $586,000 in restitution to US Airways.

Context, little girl. Try reading, for once.

Doc 1 - Company Complaint
Doc 4 - Cleary Summons
Doc 10 - Motion for Preliminary Injunction
Doc 11 - Memo In Support
Doc 21 - Motion for Preliminary Injunction

Doc 1 - Company Complaint example - USAPA is directly instigating the illegal slowdown by encouraging pilots to delay flight departures, not complete certain training requirements, decline to fly on the basis of fatigue, increase maintenance writeups, and generally slow down in the performance of their duties — and also by threatening to expose and retaliate against those pilots who do not participate in the slowdown. Although USAPA is encouraging pilots to change their behavior under the guise of “safety,” USAPA’sown communications confirm the true purpose of its campaign is illegally to slowdown US Airways’ operation in order to gain leverage in contract negotiations. For example, USAPA encourages pilots to “Fly Safe” and “slow it down!” in a publication describing what it will take for US Airways’ pilots to win their “battle” for a new contract. And USAPA’s Strike Preparedness Committee — not its Safety Committee — issued a publication stating that “it is time for us to make a concise and powerful statement that we will no longer tolerate unfair working conditions” by “MEET[ING] OR EXCEED[ING]” all “safety standards” “in every single decision that we make” and concluded by stating that “[a] storm approaches.”

I just read the Company's Complaint. All I can say is Wow!! USAPA is more than dead because the company has done their homework. And, if I was a yellow necker I would take the lanyard off or a pilot may find them self in an unemployement line in short order.

Listen up guys. This is one area this guys knows about.

Why do unions so often tend to go the mafia/thug route in their behavior? Seems like if you acted like professionals you stand a better chance of being treated like ones.

Hey pro, you didn't answer me on the other thread. Since you are so sure the fumes problem is a job action, care to take me up on my offer to set your office up with some hot turbine oil? If the crock pot was too much, maybe a nice little potpourri burner would be more your style. You could be our little canary..............you know, prove the point it's harmless.

Wonder how USAPA is going to pay for this.

If it comes down to an assessment, at least the west won't have to pay.

And USAPA won't be able to fire any west pilot for not paying.
