First, APA can change whatever they want.

If that proved true; "you'se", and all USAirways pilots could then fully expect to become the "seniority" doormat under the American side's feet.  See TWA, Reno, etc for historical references. To even imagine otherwise requires far more blissful ignorance and such an utter dearth of situational awareness than could possibly be covered by (or even dreamed of) within the term Naive.

"With little notice, APA’s Merger Committee demanded USAPA allow APA and the Company the option to modify the Protocol Agreement should APA be certified as the sole bargaining representative by the NMB. In effect, APA wants the ability to negate agreements made in the past, after it has been certified as the single bargaining representative. Changing rules like this would create an unfair situation..."

Just fun to read it again and again, the crying and all.  It's entertaining seeing you little girls cry so much.

They can't change the law and there is a legal reason they wanted the ability to modify the protocol agreement as a single CBA because none exists in the MOU. USAPA will be around in some form to exert MB rights or sue to have the law enforced. At which point your management will say, oh well no JCBA until the litigation is resolved so whatever they are saving by not having it completed which is likely a couple hundred million annually will more that pay off draging it out for years. They have already showed how they will throw the litigation card to the NMB and say we can't negoitate an agreement till this is all resolved.
USAPA is decertified once APA gets the property. Curious as to where you think the money will come from for all this litigation. East Spartans?

All wrong. The APA is gifted a "Wide range of reasonableness" to go about whatever business it wants. If, after the fact, you think you've been wronged, just find a few million dollars and sue. Be mindful of ripeness and statute of limitation issues though. The APA are pros, USAPA was a pathetic rookie at best. The APA doesn't need. Plan B or the East pilot committee for anything.

I think they forget MB states if there is a dispute in seniority, it is remaned to arbitration in accordance with section 13 of the A-M LPP's. Of course your MOU states that can't happen until you have a JCBA and the law says if seniority isn't resolved after 20 days an arbitrator is struck and the dispute is submitted to the arbitrator which will render a decision 90 days thereafter. Hmmm........It won't be over by the fall.
Anything that delays is fine by me. The attrition is really kicking. I predict 190 Captains wearing American uniforms within 6 months of hire. 1984 hires left seat of 330 very soon.
Once they are in, they are locked.

We wouldn't pick a name of a group that committed suicide.

Yep, USAPA is being neutered... Let's all be good union pilots!

Al Qaiada is probably a good match for you.  Something about "strength and honor" just doesn't seem to jive with your kind.

East-Qaida. I hope East likes it. We'll find out once he regains consciousness from his alcohol-induced blackout.

Well sounds like is going to be separate ops for quite a while, works for me.

Why would they shift it west? The company is already flying more out there now than economical.
Since the new American is now the largest airline in both LAX and DFW I think there's one extra letter in "shift" West.
