The APA counter suit::

"APA seeks a further declaration that, following USAPAs decertification as the collective bargaining representative for legacy US Airways pilots and its replacement by APA as the collective bargaining representative for all US Airways and American pilots, USAPA may only participate in the MOU seniority integration process if and to the extent deemed appropriate by APA."

The APA is your friend. Really, trust them implicitly. They will take care of everything. Relax. Close your eyes. Breath normally. Think about your "happy place". All is well.

 
No joke. The same outfit who's despicable actions caused MBond now want to make an end run around it. Big surprise there. Seriously; ANYONE who could possibly read that as meaning anything other than the APA wants free reign to hose the US people without interference, or even representation from the US side is truly, at the very best, a completely hopeless village idiot/utter moron....which naturally means that more "spartan" cheering must soon be expected. 😉

Well, it took no time at all to prove the "more 'spartan' cheering must soon be expected." I'll leave those gifted with above sea sponge level IQ's to assess the validity of the "hopeless village idiot/utter moron" portion.

provides that the requirements of Section 13(a) “shall not apply if the parties by mutual
agreement determine that an alternative method for dispute settlement or an alternative
procedure for selection of an arbitrator is appropriate in their particular dispute.”

96. The MOU provides for an “alternative method for dispute settlement” within
the meaning of Allegheny-Mohawk Section 13( B), thereby rendering Section 13(a)
inapplicable to the US Airways/American pilot seniority integration.

Why is it so torturous for the APA to do so, and from what even possible delusional fantasy can the west even conceivably now imagine them to be your best-friends-forever? Are "you'se" folks all simply insane or what? 😉

I believe that a protocol agreement would have provided the details of any dispute resolution process. No protocol was concluded. Therefore, no dispute resolution process exists within the MOU. Therefore, Allegheny-Mohawk applies.

What don't you get about that? USAPA has unwaveringly claimed for years that they are "fairly" representing the West. Being you're a USAPA cheerleader, you should be comfortable with The APA returning the same "fair" DFR to you. Unless you somehow...rather HYPOCRITICALLY are changing your opinion for some reason.

An East guy wouldn't dare to so obviously display his situational, hypocritical "ethics" now would he? HA!

The enemy of my enemy is my friend. I don't worry about APA as they've made it crystal clear that they're embracing neutral, final and binding arbitration for all parties. USCABA has refused from day one to even allow for the slightest possibility that the west would be fairly treated. Everyone knows Karma is real, hence the continued intransigence of the East scabs. They know how badly this can turn out for them when they lose all control.

I get that part, but where I see absolutely no sense evidenced here lies within the insane assumption that the APA's now somehow, as if by magic, your supposed friends. "The enemy of my enemy is my friend" actually makes no/zero/zip/nada logical sense whatsoever, as any first year student of even the most rudmimentary notions of logic and philosphy knows. Especially in this instance; if the APA is indeed an enemy to the existing union and by your assumption, the east; exactly WHAT magically makes them any supposed friend to the west, within the USAirways side? Derisive, jocular notions of "spartan" stupidity aside; "you'se" folks can't be that truly dense, so the furious flourishing of pom poms for the very outfit that gave the world MBond legislation and that's now trying for absolute control and a side-stepping of that same legislation seems insane to me. Others' actual mileage may vary. 😉

It makes perfect sense. They're leaving it up to a panel of neutral arbitrators. That's vastly different than force feeding their version of "conditions and restrictions" to determine your future. This is really an easy thing to understand. Which explains your difficulties.

I am aware that USAPA wrote to Senior Management complaining of an email this BPR received from a former West Pilot.

Though the email was not of my taste, this act of USAPA is wholly inappropriate, and will not be tolerated.

For the LABOR UNION with the DUTY TO FAIRLY REPRESENT the PILOTS under the EMPLOY of US AIRWAYS to COMPLAIN to the MANAGEMENT, it is yet again an indication of the HYPOCRITICAL behavior of USAPA and must stop immediately.

I know of NO COMPLAINT from USAPA to Senior Management regarding ANY former EAST pilots behavior. Most notably the letter written to Judge Silver denigrating and making outlandish disparaging statements regarding the pedigree of former America West Pilots.

Shame on you and USAPA for allowing this and NOT DISCOURAGING this brazen act.

I remind you of your DUTY TO, not only your DUTY FOR the Pilots of US Airways.



As President YOU and USAPA owe this PILOT an apology.
