This is APA Communications Committee Chairman Capt. Tom Hoban with a follow-up APA Information Hotline for Tuesday, Jan. 14. (Read the previous hotline detailing the results of the tax-deferral survey and the board's direction regarding the question of tax deferral.)

APA FILES SINGLE-CARRIER PETITION: Today, the APA leadership and general counsel filed a petition for single-carrier/single-transportation-system status with the National Mediation Board (NMB). This filing is done to determine the representative body for the pilots of the new American Airlines as we proceed with upcoming joint collective bargaining agreement negotiations and the seniority integration process.

The NMB will conduct an investigation to determine if American Airlines and US Airways should be considered a single carrier for transportation purposes and if an election for representation should be considered. Other unions may intervene in the election if they provide an adequate "showing of interest."

Your leadership anticipates that APA will become the representative organization for the combined pilot group. The NMB will likely render its decision within the next six months.

APA BOARD OF DIRECTORS SPECIAL MEETING: The board spent a portion of the day in closed session for briefings by the Seniority Integration Committee and Director of Safety, Training, Security and Aeromedical Ray Duke.

Also today, the board approved a series of three motions reconstituting the APA Appeal Board in accordance with the APA Constitution and Bylaws Article VII D. and Policy Manual Section 4.01. Capt. Jim Condes will serve as Appeal Board chairman and a regular member, FO Chuck Barnett and FO Lisa Heller will serve as regular members, and Capt. Scott Hollinger and FO Katie Fletcher will serve as alternate members.

In addition, Flight Time/Duty Time Subcommittee Chairman Capt. Doug Pinion and subcommittee member FO Carrie Giles recapped the major issues associated with implementation of FAR 117. We recommend that you review the latest FAR 117 Q&As issued earlier today if you haven't already done so.

The board recessed at 5:30 p.m. and will reconvene at 9 a.m. tomorrow.
MOU States:
 
"26. APA shall file a single carrier petition with the NMB as soon as practicable after the Effective Date, when APA determines that the facts support the legal requirements for the filing of a petition but in no event later than four months after the Effective Date. If and when the NMB makes a single carrier finding, the single carrier acknowledged by the NMB and the certified representative shall be governed by this Memorandum."

This will get worked out in the protocol agreement, FYI.
