Nope. You've entirely misinterpreted the point. USAPA has never understood what a union is and actually does. Do you have a blended DOH list? Nope. And you never will. USAPA is already completely irrelevent. This letter is checking a box and further evidence for the future arbitration. There is a reason it hasn't been answered and it will probably be ignored because any answer is not going to reflect well upon USAPA.
Silver put a bullet into USTUPID. It's dead. Nobody cares. Everyone is just watching the NMB clock at this point. USTUPID will pull every trick imaginable to stop the single carrier determination but will be blocked every step of the way. There is nothing USAPA can do to save itself. That's the point of Silvers ruling. Cut out the cancer and let the sane continue. The Nic award still hasn't gone anywhere. You'll never erase the "powerful evidence of a fair result". Especially in front of the next arbitration panel...where you have ZERO input.
Silver simply recognized the MOU as seniority neutral...you know..how it was actually SOLD? So here you go again to arbitration where anything can happen. There is a very real chance you're going to end up wishing you took the nic. Oh so APA would rather put younger junior new hire west pilots higher up the list. And allow such junior pilots to take those open AA Capt attrition slots by young west AWA pilots. Don't see that happening

True... and besides, since when did APA worry about lawsuits?  The West thinks they have such leverage with a lawsuit.....   ooh, scary!!   Even if we ASSUME the 2005 TA is NOT nullified, we do have to remember it was APA that stapled most of TWA for furlough fodder and where smart enough to get ALAP stiffed with the DFR.  😀  
 
I can't think of any scenario where the APA is worried about a lawsuit.

Good West pilots have kept Usapians from taking ALL the jobs brought to the acquisition in 2005.

They keep throwing the lawsuit threat and that is all it is after the Ninth and Silver twice but they fail to realize if the MOU is violated and the tennets of McCaskill-Bond are not followed there will be a protracted legal battle. I guess by their logic the APA and New AA will just leave all three groups separate forever.
