According to the agreement with apa and USAPA, the seniority list integration requires it to follow the McCaskill-Bond Amendment.
apa wanted USAPA to give up McCaskill- Bond protections. USAPA respectfully declined.
There is a provision in the memorandum of understanding that amr pilots and US Airways pilots are allowed to extend the timeline of their attempt of a seniority list agreement, before mandatory arbitration, if both parties give the ok.
The agreement is required to be voted on separately by apa pilots and US Airways pilots. If both official CBA represented groups vote in favor of an agreement it becomes a legal finality.
If there is no agreement it requires arbitration, in which neck ties and staplers are not required nor will they be allowed. Arbitration is the only other option wich will be a legal finality to the seniority list integration process.

The conditions will be legally met when we have one contract, which will be soon, and the document was never nullified. Get used to it.algflyr said:

A transition agreement was created that produced a SLI under ALPA (the Nic) and it contained certain conditions that must have been met for the implementation of said seniority list. The conditions were never met. And now the document has been nullified, so those conditions can never be met. All we are left with are two separate pilot groups operating separately from each other on two different seniority lists.
