The Nicolau arbitration said those who were actively flying at the time of the acquisition in 2005, that pilots who were actively flying at the time of the merger should not be replaced with furloughed pilots. You installed an East Union and management, it is no suprise who got recalled and who was furloughed. The arbitration called for no windfalls, guess what you got your winfall already so don't expect and windfall with AA. History will show the airline which was hiring at the time of the acquisition (America West) stopped until the East pilots were recalled. West pilots got furloughed by their new East bosses. Parker was more than willing to use the services of pilots who decided to remain under bankruptcy wages so it is no surprise the East grew and the West shrunk. I did not see much help from USAPA other than helping themselves to all the benefits.

I guarantee you one thing, we'll be at the table, show the history and the impact on West pilots as a result of arbitration evasion. We've had a legal team in place for years, they know the opponent well. They are committed to seeing this process through to the end and will counter any attempts otherwise.

One other thing, you play like this is AA vs the former America West. Don't you have your own case to present? You need not concern yourself with our merger committee. Worry about your own merger committee.

The AA pilots need to watch you guys like an Eagle. Plug any escape routes in agreements made considering your history of evasion.

There has been a civil lawsuit filed by 3 pilots against the USAPA principals, and that lawsuit will continue until there is a settlement or final judgment. What this means is that it is really up to the plaintiffs (Bollemeier, Parrot, and Tracey) to decide what terms they are willing to agree to in order to stop the lawsuit, and how much towel the defendants will have to throw in before we make the lawsuit stop
Nonetheless it places individuals in a position to have to defend THEMSELVES! They cannot not use Union dues.
Count 1 in our prayer for relief asks for a full accounting (which is our right), and a subsequent forensic examination of their books will certainly uncover this sort of illegal "reallocation" if it actually occurred. In that case, we would submit the evidence to the DOL and/or other enforcement agency for them to file criminal charges.
How about send them all to jail and enjoy some Bubba time.

Correct. Remember that the LMRDA was a pretty staunch legislative measure designed to thwart union corruption, and it does to by placing alot of power in the hands of union members. You will never see more hand-wringing by union attorneys than when facing an LMRDA issue.
This lawsuit is brought under the LMRDA for violating that statute. Far more serious, and it has been approved by a judge to proceed
Rest assured those named defendants aren't sleeping well. There personal wealths are at stake for every penny they have spent in violation of the act. And, using Usapa treasury funds to defend themselves is prime fascia proof they are violating the act.
The consequence here is financial liability and legal defense costs to the individuals named.
That is correct, it is against all current and former officers and board members who voted in favor of not refunding dues money as per the constitution. They will not be able to use union money to pay for their defense, if that happens they will be liable for that much more

Add a clause to those terms to include an apology to each of the Cactus 18 and their families.

No little umbrellas for me.  Though I will miss all the awesome German, Belgian and Irish fresh draft beers, I will happily enjoy my 40 cent San Miguels.  Of course, that's Happy Hour prices.  Normally they sell for about $1 a bottle, and they're  surprisingly good!
 
Of course, my taxi ride across town to the bar will run me 35 cents.  
 
Stocked up already on my dermatologist-recommended Eucerin Daily Protection SPF 30.
 
Life is good, and will soon be better!

As it "forever" should be Brother....I like to think we've actually, against all odds perhaps, even honestly earned that by now. 🙂 I'll naturally and always, properly and humbly leave that personally arrogant presumption/BS to God's Judgement on a day-to-day basis though...There, but for a blood vessel more severely torn/no helmet taking the force of that bike crash/the F'n reserve 'chute finally opening/shells/that missle that missed/even just the slick spot stepping into the shower/whatever/etc, ad infinitum.....Meanwhile? Kirby: We expect an AMR-US Airways merger to resolve our pilot seniority dispute

US Airways president Scott Kirby said Thursday that the airline believes a merger with AMR and American Airlines will help US Airways resolve the prolonged seniority dispute of pilots at US Airways.

Responding to a question at the Bank of America Merrill Lynch conference, Kirby talked about the dispute between pilots of US Airways and America West Airlines after the 2005 merger about how they would combine their seniority lists.

Here is his answer at the conference.

“Yeah. It’s ironic but the solution to that issue at US Airways I think it’s probably because we’re able to get this deal done. The area that people focus on the most is USAPA, our pilots’ union. In this case there is a huge benefit for our pilots in getting the deal done. They can go to the new contract at American, which is a very large pay raise for the US Airways pilots. So as I fly around the system, as I talk to the union leadership at USAPA, they want the deal to happen and they want us to get it done and they are working cooperatively with us and with APA to get the deal done.

“As to the seniority integration issue, I think this is the way out of the box for them. For those of you that follow the industry, there has been this seniority fight between the former US Airways and the former America West pilots. And as long as that seniority dispute is happening and isn’t resolved by a court, they really can’t negotiate a single agreement with the company because they can’t agree on what’s going to happen with seniority. And they are waiting for a court to answer that question for them.

“This is a way to start over and — not start over completely, but at least have a fresh beginning. Today, you know what, the analogy I use is that they painted themselves into a corner into a room, and neither side can compromise. This is a way to start the process over in a new integration.

“There is also federal legislation, the McCaskill-Bond legislation, which will mandate binding arbitration. So the plan in this case is that our union and APA combined will have a joint contract, and we will have that hopefully on the day we close the merger, assuming we do.

“That contract will be in place and so there will be a joint contract in place. And then more than likely the seniority issue will go through a process and ultimately get to arbitration. But because we will already have a joint contract in place, that arbitration will be binding. It will just get implemented.

“In the US Airways – America West case, it went to binding arbitration but there was a requirement as part of that that the two unions negotiate a joint contract with the company, which wasn’t done yet.

“And because it wasn’t done yet, the side that didn’t like it could prevent a joint contract from getting done. And because of that, the seniority integration never happened.

“In this case, there’ll be a joint contract in advance, and the seniority integration will happen.

Pilot: . . . . My question though is I was at the hearing for the furloughed guys and one of the possibilities they were discussing is moving 190s to the west and can’t do that. You know why.

Parker: Why

Pilot: Binding arbitration. So the company believes in binding arbitration. We have a binding arbitration for seniority. Does the company believe in binding arbitration or not?

Parker: The binding arbitration you’re talking about I think – I’m pretty sure what you are talking about – that was an ALPA process that resulted in binding arbitration. That wasn’t a company process. That’s ALPA to ALPA seniority integration that says if you can’t get it resolved we go to binding arbitration is ALPA policy not company policy. If the company’s in binding arbitration, yea we believe in binding arbitration.

Well, San Miguel is certainly not available in Staten Island for 40 cents at any time!  Nor the 35 cent taxi ride across town.
