They didn't hint at anything. They said that there was an injunction. Judge Lane is a smart man. I guess he didn't want to get wrapped up in this BS. Sounds like he thinks it will be bounced out of court in short order anyway.

I think by "injunction" they meant that AOL's lawyers would have to stipulate that they would not interfere in any way with the merger. I guess this takes the wind out of Marty's sails.

No one was enjoined and I'm curious ad to why USAPA would even hint at it. It sounds like they're writing up an understanding and signing it. Doesn't sound like a loss. The only denial I saw was the request to move to NY.

Excellent news for the West Pilots from the NY BK Court this morning. We are preparing an update that will be published sometime later today as we are still processing the information received from our attorneys (actually still on a conference call with the attorneys). Basically, Judge Lane will issue an Order soon to dismiss usapa's NY BK action with prejudice.

When a court orders you to do something, it's hardly a "gentleman's agreement". Nobody would confuse AOL, it's lawyers or members for "gentlemen".

Take it easy on them. They are going to lose the donations if they don't spin the loss correctly. Marty stepped on his crank again, there is no leverage whatsoever with AMR from Leonidas. In fact they were politely shown the door.

Damn another loss and waste of money by the legal brain trust called usapa.

No permanent injunction on the west because the case was dismissed. No transfer to NY because judge Lane refused the case, dismissed.

Not much of a victory for usapa. The west agreeing not to do anything we never intended to do. The west was never going to try and stop the corporate merger. The Arizona case will define the seniority integration (merger).

Spin all usapa wants. They lost. Judge Lane tossed usapa out of his court.
