During the time Stephen Wolf was the CEO we were the highest paid in the country and during that same year the airline made a profit of $1.6 billion.

SWA is now the highest paid passenger airline and they for the past 30 years have made more profits than any other airline.

That is the most useful info in months, and it isn't a conversation about "less filling! tastes great!"

The bottom line is your western group and legal never had a grip on any of this. Ever. It has been all empty posturing. Started with McIlvenna and him being totally clueless. Warned time and again what would come to pass. Warned the easterners would vote the entire airline out of ALPA. It happened. Then it went to the Wake court. Warned again it would go to appeal. It did and you ignore the true warning the 9th gave. Over and over. The Nic is just a proposal. Nothing more.
Tomorrow will be an affirmation of the 9th. If Silver pulls a Wake, it goes right to the 9th. This time if it does there will be no question and the stupid re hash of Nic 4 and the ridiculous HP. Both are in over their heads.

What you don't get, or maybe you do and are just hiding your scab agenda, is that the "it" was reached in a binding arbitration among the members of the two factions, who are now both represented by the scab union.

"it" is not going away, and if Silver rules in favor of "it" you will not see the 9th overturn "it" either. Did the 9th invalidate "it" last time? Nope, absolutely not. You are right, they did affirm that "it" was a bargaining proposal, but they did not touch the thorny question of whether "it" was binding on a scab union. They did however warn that dissent certainly thought so, as did the circuit court, as did the jury, as does the company as evidenced now by Siegel's statements for the company in Silver's courtroom.

You are foolish because regardless of what you want, DOH was never going to be adopted as the SLI methodology, regardless of who you got as an arbitrator. Once the neutral third party handed down his ruling, you continue to be foolish for not abiding by it as promised. Do you think the arbitrator would have taken the case if the east had refused to agree to the terms right from the get-go? If they had told the arbitrator that if he hands down a decision they didn't like, they would walk away and form their own little He-Man ALPA-Haters club to weasel out of it? In a previous post you said that those who disliked USAPA enough to withold their dues to the point of termination would earn your respect (warped, my friend truly warped), why didn't you hold your own cabal to the same standard and demand that they be up front enough to tell the arbitraor that they would have no intention of abiding by any decision that didn't give them what they wanted?

So grow up and accept things as they are and stand behind your word as an adult. Or just shut up.

Still arguing over who bought who and the Nicolau is not fair.

Well we should find out tomorrow from judge Silver the direction we are going. Remember the hearing is not if the Nicolau is fair, there will never be a trial for that. Fairness was decided by Nicolau. You guys can go to your grave believing whatever you want but I think you will end up living or quitting under the Nicolau.

But just to add to further to your disappointment the PBGC filed their report with the court today. After spending $4 million and promising someone was going to jail and the PBGC checks would be bigger, once again usapa failed to perform.





This could end up being a very bad month for the east pilots and usapa. No joy on the PBGC $4million wild goose chase. Judge Silver put a stake in the heart of DOH. The company announces a merger and APA becomes the majority and east pilots learn what majority rules means.

Halloween could be very scary indeed for east pilots this year.

Your entire "argument" (if one may be so extremely generous) is one of the purest, situational opportunism (how to manipulate a given scenario) and offers nothing whatsoever that even begins to address principles or morality. IF the magic day ever arrives when either of those latter items even crosses what you laughably pass off as a "mind", then perhaps, just perhaps some possiblity would exist that would allow for adult conversation. PBGC’S NOTICE OF FILING REPORT OF PLAN ASSET EVALUATION

It is a court filing I just copied it to the board. I did not post the actual report. Should we want to see how long it takes usapa to inform the membership of the "bad" news.

The CPA firm found no indicators or instances of fiduciary breach, conflicts of interest, fraud, or improper transfers of plan assets. Ex. 1 at 9-11. It based those findings on: (i) its completion of the agency’s risk assessment checklist for fiduciary breach and conflict of interest;and (ii) its analysis of the Plan’s audited financial statements, the former trustee’s plan accounting reports, and IRS Forms 5500. Id. In addition, the CPA firm “remained cognizant during all testing procedures of the risk of potential fiduciary breaches, conflicts of interest, and/or fraud.”

$4 million to find out that nothing was done wrong. That is a wild goose chase. The PIC claimed they were going to put people in jail for fraud and they were going to get more money. Maybe you guys should ask for gold badge backers at least you would have something to show for your money. Because that was forced taxes unlike the Leonidas donations.
