No, the company agreed to make all previous agreements and status qou a nullity upon the effective date.
So the company and USAPA both lied that the MOU was neutral on the Nic? Call Silver and let her know how much time she's wasting.
 
The usapa C&BL can sau anything they want. They do not trump federal law. When the NMB rules the APA to be our bargaining agent, usapa disappears. No more officers, no more board, no more dues, no more bank accounts.

Take the time to read the APA/TWA arbitration. A couple interesting tidbits in there. The one that you need to pay attention to is footnote 9.


The only thing you were able to do is delay the Nicolau. But that delay cost you hundreds of millions of dollars.

Did ALPA disappear when it was no longer our CBA? Did you get a refund of the thousands of dollars you sent them(oh, that's right you guys didn't send as much as we did)? Who paid for the defense of the MDA DFR suit, USAPA or ALPA?
 
Where in the MOU is the East West issue addressed?
It is addressed in the statement that the existing lists (plural) cannot be changed by the MOU/MTA/JCBA , only the new AA SLI.
And, as the existing TA becomes nullified, along with all other contracts/agreements at the POR, the only agreed to procedure for east/west list integration is through the SLI process with APA.
You know, the judge might just order that USAPA must present two lists - as the ratified MOU clearly states - instead of the feared single DOH list - OR instead of the NIC!
So, can a court order trump federal law?

Going into MB with the NIC would be one sided. Going into MB with DOH would be one sided. The MOU has USAPA entering into MB with 2 lists. Very Neutral. I do predict the case will be dismissed after the hearing. I also predict Hillary as the next president, as well as the Browns winning the superbowl.(not really on the third.)

I accepted back around 2005 that we wouldn't be integrated by DOH, so you shouldn't make assumptions.

I fully expected the west to push back. I have a west friend that I told "If USAPA is elected then I think we will be bogged down in at least 5 years of lawsuits and will go nowhere." Was I right?

You won't see me in court, I won't waste my time. I don't like PHX this time of year and only go when assigned. \

I understand your POV, I just get sick of the incessant whining! We made our decisions, you made yours, we just have to live with them and see how they turn out.

Bad weather, I think. I've been off for several days and was called for a trip tonight on my day off. Wasn't available. Looked at catcrew and no reserves available until the 1800 PT was up. Plenty tomorrow.

Crew planning?

In talking with some of the reserve guys and what kind of trips they are being called out on. It kinda looks like scheduling is burning reserves left and right for every little 30 min to 1 hour delay to try to keep the on time rating up, then when the big weather really sets in there is nobody left.

Spoke with several over the last couple weeks that stated they were called out to fly a single turn out of a pairing that was only running a little late then the original crew picked it back up after that. Bam another Capt. F/O and 3 to 4 reserve F/A's useless for the rest of the day when the afternoon storms show up.

Bottom line.

There's no job action on the East and there is none on the West as others suggested on the other thread.
