I found this answer (USAPA's answer) to the complaint to be particularly humorous.

"89. Denies the allegations contained in ¶89 of the Complaint, except admits
that Plaintiffs contend their standing to enjoy and protect the seniority rights established
by the Nicolau Award arises from their status as West Pilots and is therefore the same as
any other West Pilot."

You might have to read it twice to catch the polite sneer at the Plaintiff's attorney. USAPA admits the plaintiff has proposed the judge can consider the West pilots to have a brash presumption or their attorney is incompetent... Standing merely because they are West pilots, and possessing all the legal standing benefits accorded to such by such means, equally to all West pilots, of course.

Not only do the western div pilots have brash presumptions, their attorney is also quite incompetent.

That's my take as well, though I differ from you in that I think it will be slotting by using 3 lists, east , west, and APA. Just a feeling from reading all the court stuff and the lack of any judge to date wanting to get too involved in "ordering" the unions to use a specific list. I think at this point anybody dreaming of the NIC being used as the USAirways list going into this process is going to be disappointed, just as the ones dreaming of a USAirways DOH list will be. My bar stool prediction is the courts are going to treat the awa/usair pilot group merger as an incomplete merger that after 8 years is much easier to consider a failed process than try to wade thru all the baggage and crap that goes with it. I think the MOU will be viewed as the way out, it puts to rest both the DOH and the NIC question and gives all groups a chance to come together as each list currently is. No matter how you look at it neither list looks anything like it did back in 2005. I don't think the courts are even going to try to sort out crap that happened almost a decade ago at this point. Time will tell.

Sounds about like what's reasonably predictable to me as well...Mores the pity in that s/he's worked more/longer than me, and should have my proper respect, has apparently long-fallen by the way of rank opportunism/"What's in it for MEEE!...Waaah!..I want whatever I/ME can get!?"

Let's just settle on beyond all possible belief. 🙂 Umm...DO be careful what you say though..one or more of them just might post a "My lawyers are tough!"/"This is Sparta!" or "Lords and Ladies/dire wolves/knights/etc..(or perhaps even the most fearfully dreaded of all "spartan"...umm..."war" cries/whines, cactus"boy"; "I will let the courts do my taliking for me") statements/videos in response!...And how could you, or indeed anyone, ever again sleep without fear? 🙂

Well any word on our president's attempt to get re-qual in the sim the other day (while on a medical) never heard of anyone doing that before, rumor has it the chief pilots office got wind of this and pulled him out. I guess he is above the law (and the rest of us).

What I find so amazing is that you easties are shocked every time one of you pulls a scub move like ignoring the rules or thinking they don't apply to you. That is your history, that is the reason for the entire organization of usapa. To ignore the rules like they don't apply.

You use the lame excuse that ALPA did not follow the rules so you left. Yet usapa does not follow the rules. Ever think hey maybe it is just east pilots that don't follow the rules and not the organization?

Just because you agree or don't agree with the current leader does not change the rules. The CLT reps were fine with Cleary ignoring the rules, now they are all concerned about following them. You guys get what you deserve.

She has called usapa' legal theories wrong. What did she say about usapa lawyers and fighting the class action?
