Maybe it was for a period of time. Since by deliberatly forcing seperate ops, the east has in effect forced a fence and DOH, I'd say the Nic plus about 100k for each furloughed west pilot should be getting closer to fair 🙂

So the usapa lawyer as you admitted had to be read twice to understand the subtle insult that the west lawyers are incompetent.

Tell you what. The west lawyer don't have to be subtle or even say a word about the quality of the usapa legal mind. The judge came right out and said it clearly on a few occasions.

She has called usapa' legal theories wrong. What did she say about usapa lawyers and fighting the class action?

Just because you say it does not make it true. The court has said your legal counsel is incompetent. Going all the way back to how you filed the names of the parties. Even Rosenblatt told you your lawyers need help.

You got it all wrong Bean. Usapians been oppressed, they have suffered too long. Our furloughed pilots must wait their turn to get the jobs back they brought to the merger but who's complaining? Certainly not the US Airline Pilots Association who claims to represent ALL of the pilots at US Airways.

Let's wait until Judge Silver rules and the APA is the representative of AALL the pilots of American Airlines to see if the whining stops.

I seriously doubt it.

The relatively small number of furloughed West pilots that chose not to take employment out East must all be doing really well in other endeavors. They chose not to come East, where guys like "Dave" can now hold 190 C/O. Good for them. It's really too bad being martyred here in West postings pays them no royalties. RR

The implosion out east will be sudden, but will it even happen before 9/24? Cracks are forming out east and the chickens are running around with heads coming off...

The lawyer that can't get the case dismissed is calling the lawyer that keeps getting it back into court incompetent. Now that is hypocrisy.


A case that you were all told was over and done with. A case that usapa promised would never seen a court room because the bargaining agent is all powerful.

Still standing. What about all those predictions of the Nicolau demise? If that were true a good lawyer could have gotten this case dismissed.

Sounds like one of those headlines in the NY Mayor race. Wait a minute, oh..."winner!"My impression of our pilot's reactions is mostly shrugs. More of the same. It's now a game of legal chutes and ladders. We either have this ended for now by Silver, and the lawsuits simply move down the line following a JCBA; or she imposes a list or gives preferred seating, and we go back up the legal chain, with even more legal actions filed. Like Phoenix, I wonder just what the tipping point would be for the other parties on changes to the MOU. APA seems to fear any kind of seniority litigation. Having apparently resolved their St. Louis issues, would they really want other East groups now suing for separate representation outside the RLA, like the West Class is asking for? Silver scheduled her trial for late September for possibly 3 reasons. It simply was the proper timeline, she wanted to wait until after the POR to impose the NIC on a ripe contract, or she simply wanted this to all go away when LOA 96 dies. I am betting on the path of least resistance and least pushback in the courts. I bet she spends a few hours with the parties, admonishes the East to play nice, and dismisses. RR

There were over 100 unfilled open positions on Bid 13-03. Bid 13-04 is published, even though you said it would not be, and it won't be filled with the Nic.

The "competent" lawyers stated the basis of the West's particular type of standing, all by themselves. You still haven't read it enough times.
