[font="Verdana""]THE UNITED PILOT AGREEMENT: IMPLEMENTATION AND THE TPA[/font]
[font="Verdana""]With ratification of the United Pilot Agreement (UPA) complete, the Joint Implementation Team (JIT) will now begin implementing the new agreement. The two important documents which will govern the process are LOA 26 and the Transition Process Agreement (TPA). The guiding principle in the integration timeline is reciprocity; as it was noted during the Town Hall meetings, “The Company doesn’t get any of their good stuff until we get our good stuff.” For example, the Company does not get movable RDOs for Basic sUAL Reserve pilots until they implement the increased monthly pay guarantee (MPG) of 73 hours. [/font]
[font="Verdana""]LOA 26 has details on over 100 contract provisions and their estimated implementation dates. The TPA contains the Seniority List Integration (SLI) protocol, and a requirement, unless otherwise agreed, that Continental and United keep their flight operations separate until the Operational Merger Date (OMD). The OMD will be the first day following acceptance of the Integrated Seniority List (ISL). The protocol in Exhibit B of the TPA will govern the ISL process, and the MEC Merger Committees will detail the steps remaining to obtain the ISL in a subsequent MEC update. This update will focus on LOA 26 and the implementation schedule.[/font]
[font="Verdana""]Implementation LOA 26:[/font]
[font="Verdana""]A contract of this complexity and magnitude of change cannot be implemented overnight and the time needed to implement the United Pilot Agreement (UPA) was accounted for during the JCBA negotiations and included in the costing trade-offs. It will take time to complete the migration of UNIMATIC to the CAL Crew Management System (CMS), and harmonize all the scheduling rules including PBS, trip trade, and vacation bidding. The UPA will also require significant training of crew desk schedulers, and most importantly, it will require more pilots due to the higher manpower requirements being driven by the new work rules which will ultimately speed up the return of our furloughed brothers and sisters to United.

[font="Verdana""]LOA 26 dictates the composition of the Joint Implementation Team (JNC members from the Company and ALPA who comprised the Scheduling Small Group), lays out specific expedited arbitration procedures if there are disputes, and lays out the implementation timeline. To handle questions and issues that arise, the JIT has established an email address at JIT@ALPA.ORG for your use.[/font]

[font="Verdana""]The Joint Implementation Team (JIT) will manage the timeline as detailed in paragraph D of LOA 26. Some provisions of the UPA apply retroactive to the beginning of the current bid month (including pay rates and B fund contribution), some provisions will take effect on the effective date of the UPA (Dec 30 for sUAL, Jan 1 for sCAL due to the difference in our bid periods), and some will be phased-in according to the chart in LOA 26. [/font]

[font="Verdana""]The chart in paragraph D has 111 items which have been identified as having a planned implementation date. Most of these items are tied to the integration of the Crew Management System (CMS) which is the sCAL version of sUAL’s UNIMATIC. Because it will be difficult to “flip a switch” and turn all UNIMATIC functions over to CMS at once, we expect a step-by-step roll out throughout the summer and fall of 2013. At the cutover point to CMS, the Company plans to implement FAR Part 117. Pilots should take time to become familiar with the new FAR, as this is only nine (9) months away.[/font]

[font="Verdana""]With respect to the LOA 26 items which need to be phased-in, until a provision is implemented pilots will continue operating under the provisions of their previous CBA unless otherwise agreed. The important milestones in the initial implementation are explained below; for the full list of delayed items see LOA 26 or the “Expanded Implementation Schedule” which is a plain-language version of the chart in paragraph D of the LOA. The JNC and JIT will provide periodic updates and strategic reminders regarding the implementation progress and we will highlight the important changes expected for the coming weeks and months for your planning purposes. [/font]

Vacation does not accrue by calendar year; it accrues by Vacation year from May-April, and the new accrual schedule went into effect November 30 at sUAL. This may change the number of vacation days by one or two, depending on years of service.[/font]
[font="Verdana""]Deadhead Deviations-[/font][font="Verdana""] Pilot can transfer PS travel authorization from scheduled deadhead to the deviation city pair. For sCAL, pilots should book a PS leg home and crew desk will authorize, process for approval TBD. sUAL- notify CM of your intent to deviate and scheduler will remark deviation in the audit trail, no change to current PS seats for deviations. To preserve rights to deviate, there is a 15 hour notice requirement, and a requirement to check at the end of the ID to see if you were reassigned. If RA, deviation cancelled. See UPA Section 5-D for deviation rules and prescribed time. Basic Flight means a Flight that operates within the fifty (50) United States, Canada, Mexico, Central America, that portion of South America which is north of fifteen (15) degrees south latitude, Bermuda, and the Caribbean Islands. Global=anything that is not Basic.[/font]

The real question is: Does the USAPA merger committee have any flexibility on DOH? If not, then they can simply attend the mediation phase by fax and save us their hotel and meal expenses.

The real question is how will an arbitration panel rule and the overwhelming probability is that they will rule fundamentally the same as the previous four arbitrations.

First Officer Jones was a valued resource and asset in providing me with information until last fall when he cut off our 16-month correspondence, which consisted of over 30 hours of long distance phone calls and over 120 emails.

U-Turn however does not “see it as First Officer Jones calls it.” He is entitled to his own
interpretation of “U-Turn and the China LOA.” We disagree. “A man hears what he wants to hear and disregards the rest” (Simon and Garfunkel, “The Boxer,” 1970).
U-Turn cannot emphasize enough that we were not addressing the East MEC in “China-Gate.”

Our criticism was directed squarely at our OWN AWA MEC for both a lack of communication with our pilot group and for our suspicions founded by their previous behind-the-scenes dealings with the company. For Eastern Szmal to suggest otherwise is a misread of that U-Turn article. But right now, he needs a straw man to deflect from his own self-generated problems.

We still have concerns that our own MEC was engaged in discussions that had “nothing to do with current JNC negotiations.” And until our MEC starts practicing the slogan they ran on, “openness, honesty and integrity,” we will call them on their own reticence, caginess and lack of candor.

Really. That is the best you can do. Some old rant. Every airline has a Herb Holland. You have CM we had Herb but he has retired several years ago.

Now how about addressing the fact that DOH puts 85% of the east pilots in the top 50% of a combined list. That DOH staples 6600 american pilots on the bottom with only 500 east pilots. No way the american boys are going to stand for that. EVER!
 
You west pilots are strange.

Well...if not downright "strange"...at least certainly unlike anything I'd previously ever encountered over many decades. 😉 They do have some decent and actually intelligent people amongst their ranks though...although we rarely see any such post here.
