The JCBA will be done and voted on before we see what lost will be used. That right there tells me it'll be two lists - Nicolau and the APA. And since USAPA can't hold the contract hostage, the three arb panel will make a decision and we're done. Notice there is no distinction between east and west but merely USAPA pilots. If anyone thinks DOH or a three way is possible, you're nuts.
And that right there tells me you're an idiot!

Sounds to me like the company just admitted in the MOU US AIrways is operating under two separate lists.

Read the MOU a little closer. Not sure what it means but. Section 10 paragraph h.

h. US Airways agrees that neither this Memorandum nor the JCBA shall provide a basis for changing the seniority lists currently in effect at US Airways other than through the process set forth in this Paragraph 10.

Since we are talking about semantics, this is nothing but legal cover. The company must remain neutral. So they agree that the MOU and JCBA do not change the listS in effect. In other words the company has nothing to do with it. What DOES provide the basis to change the seniority listS currently in effect is the TRANSITION AGREEMENT, which keeps the lists separate until we (east and west) are working under a joint contract. THAT is the basis for changing the lists. Not the MOU in and of itself. The Nic has already been accepted and paid for as provided by law. We will be working under a single contract before entering MB arbitration with APA. Hence the Nic will be merged with APA's list accordingly. Checkmate.

It does not say that at all. You are interpreting it that way, but that's not what it says. It says that the MOU and JCBA do not provide the basis to change the lists. That is technically a true statement. Our current Transition Agreement provides the basis. The paragraph you quote is simply a means for the company to stay neutral and say this merger has nothing to do with seniority.

I believe what it says is that if it goes to arbitration, and it may or may not, then the JCBA must be completed prior to seniority integration arbitration. 10.a. lines 7-9
 
'During the McCaskill-Bond process, including any arbitration proceeding, US Airways,
American or New American Airlines, or their successors (if any), shall remain neutral regarding the order in which pilots are placed on the integrated seniority list,'

They got the 9th's ruling wrong.

They don't understand what Silver told them.

Now they don't know what to make of the MOU.


I will just go ahead and spell it out for them. The company that has testified in court that the Nic is the status quo, only accepted system seniority list, per the MOU will be a party to any seniority integration under MB.


See, what is meant by final and binding yet?

I should probably be arguing about who is going under who in the seniority list, but I can't help but be hopefull about the outcome of a merger. I'm not talking about the seniority, but the airline. Maybe it's because the pilot that mentored me in aviation was a captain at American. Maybe it's just shiney jet syndrome setting in (polished B737-800), I don't know, but I think the merger could be a good thing.
