My point is that often times the only evidence a proscutor has is "he said, she said" or "they said" from those accused or accuser. In these type of cases one can only look at one's motive and credibility on both sides, specifically, if there is lack of concrete evidence of who initiated the first punch and who was acting in self defense.
Sometimes, the one being accused was acting in self defense and just happens to be the better hitter. For example, the bully who gets his azze whipped and cries "foul"
