What trump card does the West MEC think they hold that would FORCE the company to put operations together and put the Nic award into practical use? Another lawsuit?
Well, that is one possibility no doubt West is evaluating.

When two parties agree to binding arbitration and the losing side refuses to abide by the decision, the winning party can go to court to enforce the arbitration award, which in this case would mean having the Nic list implemented at the appropriate time.

The law is on the west's side. Prater has stated correctly there is no basis for overturning the award because no reasons have been presented. The award has been out for over three months. In America, the rule of law trumps emotion and politics.

You might be right, but I doubt if you end up enjoying it. The PHX and LAS crew bases will not shield you from the hate this will generate. Too bad things didn't turn out better for both sides.

I am neither bitter nor hateful. I don't hate anybody. I have eyes and I see whats happening around me. There is a bitterness and hatred that I have witnessed and you have yet to be subjected to. My point was, if this award is pressed, it will unleash something awful. This company may not be able to recover from it. ALPA surely will not.

Driver, you ask good questions. Unfortunately, no-one has the answers. I believe that fences and restricitions would be a part of a combined contract. The west is not willing to re-negotiate the Nic award on its face. They have allowed for compromises during JNC talks. A re-ordering of the list, however, is not possible.

If nothing else look at it from the political perspective of the west MEC. Were they to re-negotiate the order of the list they would be exposing their membership to potential furloughs and to a disadvantagous position should another merger occur. There is no way to sell this.

As far as the bitterness and hatred. I have jumped on east metal and had easties jump with me. At the worst the situation has been cordial. That said, I am not looking forward to combined operations. The ugliness potential is high and our ability to extract meaningful contractual improvements from management is severly comprimised.

You make excellent points. Most people have adopted a wait and see attitude but it is temporary. Somebody better come up with something to make this work. There will be NO winners if we stay on the present course.

I dug through all of my crap and updated my logbooks and resume about a month ago.

There was a lot of math that went into those numbers and as I recall it was all about compelling East pilots to accept the Nic award.

I don't think it has anything to do with what F/Os make per year.

Here's the whole thing:

The following is the approximate economic gain that the average East pilot would have received under management’s first proposal:

Captain: $28,975
First Officer: $15,766
These figures include an additional 10 days of vacation for pilots at the top of the accrual scale. Of course, this does not include the substantially improved work rules East pilots would gain, as well as full pay for deadheads, much improved pairing constructions rules, more golden days, 12 to 13 total days off for reserve pilots, etc.

To “pay it forward,â€￾ if we could have generated a joint contract by December 2007 prior to the East meltdown, and the East continues down the path of separate operations with no gain likely until at least two years past their amendable date of December 2009, that means the East MEC have likely forfeited the following amounts on behalf of their pilots:

Captain: $115,900
First Officer: $63,064
