So in your world of pink sky and purple oceans pilots decide who stays and goes in a law suit?

Just like you think the west pilots created and awarded the Nicolau list.
 
How am I wrong? Has the Nicolai list been put to rest? Does usapa have a DOH contract?

When we end up with a contract and the nicolau list 6 even 10 years after the fact was it really an alternative or just a very expensive delay?

ALPA merger policy, now we have USAPA merger policy, so in your world the company was never mentioned in front of WAKE or excused!

Having attended the trial and knowing Marty, I have confidence in our legal team. Seham looked like a law student in the courtroom. There were so many sidebars Seham should have been staggering if Judge Wake was serving drinks. He was having to babysit him instead and handed him a pacifer to stop the whining.

You're funny M&M. I was there when Seham & Cleary had their tails between their legs standing by the elevator after their defeat in Phoenix.

I would not count a punt by the 9th Circus a win.

by the Ninth Circuit results in the vacating ab initio of all substantive findings and rulings
in Addington I, as if it never occurred. As observed by Judge Wake, “the substantive
rulings in Addington have been vacated pursuant to mandate, and both cases would now
write on clean slates if there were anything to write in Addington, which there is not.”
2010 WL 4117616, at *2 (D.Ariz. Oct. 19, 2010). The Ninth Circuit’s reversal
“effectively annuls or sets aside the lower court's decision for all purposes.
Consequently, any issue implicated by the reversal must be readjudicated as if the

an alternative would have been to negotiate in good faith and come to an agreement before going to arbitration. But arbitration puts an end to alternatives.

You are clueless as usual. There were many paths we could have taken after the Nic came out. You saw one path, accept the Nic, get a joint contract get your windfall and move on. The majority of the east didn't. Those paths lead to two very different conclusions even if we end up using the Nicolau award in the end. It led to different people in different seats. It changed plans for moves. It kept people commuting and it cost both sides money that will never be replaced. It's not the same result. Alternatives.
 
I really believe Judge Silver would do us ALL a favor if she would get on with it and render a judgement. This has drug on far too long.

Why should she? The pilots have the power to change course by holding a representation election. Waiting for someone (anyone) to come along and do what you are capable of doing for yourself is just plain lazy.

The solution is in the ballot box, not the courtroom!!
