I only use the scab word either specifically regarding certain individuals....i.e. scab Bradford...scab Mowery...etc.

Or, as a general term to discribe usapa supports who are actively persuing other peoples jobs.

A number of pilots were refusing to pay the PIC assessment, resulting in pilots falling into Bad Standing for a relatively small amount. (Bad Standing occurred after missing 2 monthly assessment payments of $45; once in bad standings, it takes an additional $100.00 to get out.) This is a situation the Department of Labor would not look favorable upon.

The West fellows can't spin their way around the fact Silver took her position DOH. This is just too funny. They think their little seniority scheme applies to the rest of the world. :blush: The generational entitlement is apparent. I guess if you were raised watching Roseanne, it does rub off..........

Well sort of.....the east had been through mergers before...and DOH is not the sequencing factor to the east list, but your DOH led you to the position you held at your former company, from that position Nic derived his list.

but let me get this straight....You think that regardless of how she was appointed to the circuit court, and the circumstances that caused her promotion, you think Silver will be influenced by her "understanding and appreciation of the concept of DOH" to rule in a manner favorable to the east and contrary to what every interested party to date (except usapa) has declared the "fair" means of integration?

You could be right I suppose...but i think Silver...being a judge...and more interested in dispensing justice than appeasing a rogue union in its DOH quest, will likely uphold contract law and the RLA.


I think Judge Silver is narrowly focused on the task of responding to the question of law encompassed in the Company's request for a Declaratory Judgement, specifically its responsibility "legally", regarding the ongoing seniority dispute at US Airways.

Nothing in the Company's request asks her to determine what's "fair". Even if that were the question at hand (which is not), do you think that conceptually, she would consider her position at the top of the Arizona Bench, which is solely a consequence of her DOH, to have been have been achieved "unfairly"?

Nobody knows what her ultimate ruling will be, under the current existent circumstances (potential merger) she may well decide to punt and put the case on the bottom of her in basket.

An interesting observation, since it's been asserted in countless postings here that literally "the rest of the world" does indeed, with great gusto, universally support the nic position....an amusing delusion, to say the least...

Yes it seems that all isn't well in whoville. Internal fighting, east on east bickering. But when $4 million are wasted chasing a ghost you will have that.

Now why do you suppose that the officers had to put out a special update defending accounting practices? Because the pension committee is trying to justify spending $4 million with zero results. So far after 3 years they are out of money and the only thing they have done is had 2 judges deny thier demand for a new trustee.

How are you guys going to blame ALPA for this disaster?

You guy always say we wasted our money on addington. Ask yourselves what was the return on investment for $4 million? Do you guys know anything more today than you knew 3 years ago? Anyone in jail like they promised? Another dime in your pbgc check? Any proof of anyone defrauding the fund?

At the only meeting iin PHX usapa ever came to someone asked what good was usapa. One of the officers answers was that usapa would file a grievance that ALPA would never allow you to file. Guess what boys. ALPA would not have filed the loa 93, MDA grievance. Or the RICO, NY status quo case or chased the pension because they are responsible adults and knew they were all loser cases.

It is your money, thank goodness the west was not required to pay for you guys emotional outburst. But think of it this way. You would be a gold contributor with the money you spent. Except you were forced to pay we were not.

There are only two choice left. The pension committee is going to have to tell you they tried but failed or come to the pilots and ask for another 1.5 million. But my prediction will be that with the merger the pension committee will blame the merger and say they didn't have enough time but they would have won. The problem is you spent 4 million for nothing. From the last report they are withholding information from you. Think they will tell you what it says after the caseis dismissed? Never.

So this is what your argument has come down to. You should get DOH because the judge got her job because of DOH.

How is the chief justice of SCOTUS chosen? Are judges unionized? So if an old judge transfered to another district can they say to the head judge get out of my seat i have seniority? Do judges get assigned cases by seniority?

Was Kasher the most senior longest serving arbitrator? If not maybe you can go to court and have loa 93 overturned since he was not selected by DOH.

I've wondered about that as well. I'd imagine she sat down to more than a very full plate of cases when first taking the position. I feel it's doubtful that Her Honor wakes up in the middle of every night worried sick over this case....

What business is it of yours? Of course some are going to object. But at least we had a pension to investigate. All taken so we could merge with the crappiest of all, who never had a pension and undermined the rest of the industry. Get a grip, or you will end up like Nic4 who is careening towards the edge......

If I had paid into this, I'd be pissed. What a waste. Remember what the company lawyer said about USAPA's lawsuits? It's not a snowball's chance in hell or a 99.999999 percent chance of failure, it's a 100 percent chance of failure (waste of time/ loser lawsuits). How many times do you have to fail before you do a self check to make sure your head isn't up your arse?
