I think an easy way to alleviate most of the issues with this "award", is to base the Joint Contract on Length of Service(LOS). Compensation, Upgrades, etc., would be LOS based. The Nicklau decision would still be the "official US Airways Seniority Award". The contract however would be LENGTH OF SERVICE based. Make it a long term contract. I bet this would pass overwhelmingly. We would then have a JOINT CONTRACT...

You're right. The Nicalou decision is the official US Airways Seniority "Award". However, the JOINT CONTRACT is Length of Service based. Nothing says it has to be as AWARDED based. Put a LOS based contract out there, it passes overwhelmingly...

He's right, there is no way to merge, and not utilize the provisions of the Award, that is what the Award is for.

But,

If you do not merge, then the award is meaningless to the two separate entities.

Aquagreen knows this is true, that is why he has not addressed the issue, and only steers the coversation back towards a merger.

To use his example, if we never have a kid together, theres no need for child support, let alone a need to adhere to a judge's decision regarding what would have been "child support"...

I suppose that strategy might have some legs to actually stretch things out if it were the first arbitration ever, but common sense dictates that this wasn't the first and won't be the last arbitration where one is disappointed. The tricks you speak of were capped long ago. I've said it before and I'll say it agian: the Feds will not allow labor to make a mockery of their laws.

Not where the vast MAJORITY were incensed. The FEDS will be in NO hurry to get involved. COUNT ON IT....

I believe the arbitrator was asked to settle a dispute as to what DOH would be. Would you like to re-open arbitration over LOS, now?

The entire BK process was made a huge mockery in recent times, howabout that PBG getting stuck with holding the bag...

Like I said before, the wheel has already been invented, it just has not been used at the Mainline level.

Using your logic, we "have" to merge PSA and PDT also, otherwise we will run afoul of the Federal Government becaus we have not merged all the subsidiaries of our corporation...

It is in the company's interest to keep us separate, esp if we drag out the negotitaions, which is simple enough to do (for either party).

ALPA National will do nothing but watch from the sidelines, otherwise they risk a DFR from either/both parties.

Would it have been better for us to be merged fairly, sure. But for the East Pilot group, it is ore to our advantage to drag things out forever, and keep what we have.

Let me draw it for you...
The arbitrator mergeged a senoirity list based on a merged contract. A merged contract that has to be voted on by both sides. That isn't going to happen on the E. Therefore you wait for court proceedings to take place and by that time a UAL/U merger will be announced....and there you have it AWA will be placed at the bottom of a list with NOOOOOO chance of any improvement for the next 1000 years to infinity...

I have already suggested this to the MEC. I suggest you voice this to them as well. It would require a small change to Section 22.C. Of course both the East and the West would have to vote on it... I wonder who has more votes... :unsure:

Agreed, keep it seperate contracts as long as possible.. I do believe that management has a huge role in this, b/c they saw a huge loophole in ALPAs merger policy.. However this will haunt them indefinitely. This award is so one sided that something is WAY fishy here... yeah ALPAS merger policy sucks.. I don't think this was intended however, it is intended for fairness; which leads me to believe the company has a hand in it. AQUA, your fear right now is showing through your keyboard, there is strength in numbers, and I really hate to tell you, but if all the laws in this country were obeyed, our country would not be in the mess it is in today.. We live among a corrupt government to say the least, and it is naive for people to think that things are cut and dry, I have only been in this industry for 7 years and i am not a pilot..but i can tell you i wouldn't be gloating so soon, because as stated before, the east will decide YOUR fate.
