Temporary Injunction against USAPA filed today

Tried to but it is in a PDF doc on the West web site. Good reading. Think this judge will do something
that the 9th would not......time will tell.

Just read the companies respose to the Dec action......they do
point out to the court that NIC places some 16-17 year employees
junior to AM west new hires WHO HAD NEVER FLOWN A REVENUE TRIP
your albatross...westies...wear it proudly. God I can't wait till we start hiring 20-30
a month...you guys are going to come UNGLUED!!!

Where do you get the idea that the east is going to hire 20-30 per month?
 
Who would sit down with Parker? The NAC? Do you think that we can get separate contracts too? No separate ops means LOA 93 and C04 for us. Accept the Nicolau or accept LOA 93. It is that simple. That is our separate ops. I am good on C04 until you decide to accept the Nicolau. Are you willing to retire on LOA 93?

Wait a minute. When an eastie said something about separate ops being good for him, you guys blasted him for it "being all about him". Looks like you are doing the same thing. What about the guys that live east? What about your guys that are furloughed? What about the guys that are close to upgrading? What about the guys that want to fly tran-atl? Is it all about you and your anger clear?

Back to the topic at hand. Not too many westie answered me, so let me ask you. If the company gets it's injunction as written and you were a captain, would you abide by it? Would you not write up maint. discrepancies? Would you fly when you were too fatigued?
 
Hey I was just agreeing with our friend "Aqua" seems alot of westies would be fine with seperate ops, I have no problem with it. Anything can be worked out. But there NEVER will be a NIC here we know that. When and if Kasher comes in LOA 93 will have to do I guess, there will be massive movement here very soon. Have fun Kids going golfing or at least trying to!!!!

Does it have to boil down to the actions of one Captain? The injunction would be against USAPA for a concerted effort to hurt the airlines's operations. The company is betting the safety campaign will be enough to convince the judge. Well, what judge in his right mind would decree that Captains taxi faster and stop making maintenance write ups? Can you see the ramifications of a judgment like that? This was not a sick out like American. That was pretty easy to single out. This is a VERY slippery slope and this judge will have his name affixed to this for a long time. I'll be genuinely surprised if the company gets what they want.

Yep, life is all about choices, and until there is something on the table that is better than what is there right now with the Nic, I chose separate ops. If the west reformers can change things and the majority sees fit to do otherwise, so be it.

I am beginning to understand you east guys. Very slow on the uptake and even slower to understand when something changes. Yes the west did want to move forward and put this company together. But as new facts came in and the situation changed we have adapted, it seems you east guys are incapable of that function. After 6 years of you guys and 3.5 years of watching usapa we have come to this conclusion. The inexperienced NAC and the angry leadership of Cleary can only get us a contract worse than what we have today. We have a min block hour so our flying is protected. The new contract will not have that. usapa is incapable at this point of even getting a contract let alone decent pay rate and they don't even know what good work rules are. It is not all about me it is the conclusion of the entire group. I have not talked to a single west pilots that is screaming for a contract. Everyone has said they are good where we are for the next 4-5 years. It is you east pilots that are now getting desperate to get off LOA 93. Enjoy as that is your future until the Nicolau is enforced by the court.

Once again you guys really don't seem to understand what is going on. It is not about the lanyards. The injunction is not about MX writeups. The judge is not going to telling anyone they can't write something up. It is about historical norms and you fools blew right through any statistical averages. Guess what as soon as the injunction was filed the east started flying a better operation. No one believes that the safety campaign was about safety. The company has piles of data. It does not matter if it is sick calls or MX or taxi speeds. Historical norms.

Don't you think that the AA pilots said the same thing. No judge is going to tell a pilot that he has to fly sick. Blah, blah blah. How did that work out?
 
I make no pretense to really know anything about this but imo DUI Doug has it to good with sep. ops.

And it's a very good opinion. $120 MILLION + per year in additional pilot costs with only $40 million in savings due to synergies from the merger. You only have to do the math to see the truth.

$80 million on the plus side of the balance sheet and bonuses tied to performance. Management has things right where they want them.
See CLT Crew News from Sept 2010... No management team will spend $80 million because "it's the right thing to do".

This is one of the funniest things I have ever read on here!!!!!!! :lol: YOU, of all people, calling anyone else slow? You have been handed your rear on most things you bring up. Nothing much has changed, you are just starting to get it.

It's not about the write-ups? One of the heros was brought in for writing up the crash ax holder twice, in a 4 day trip. And guess what? It was actually.............broken.

Here's what the company asked for:

Including in such notice a directive from USAPA to US Airways’ pilots
not to engage in a concerted refusal to perform normal pilot operations,
including but not limited to, slow taxiing, writing up maintenance items,
calling in fatigued, delaying flights, refusing to answer a call from the
scheduling, refusing to fly an aircraft that meets legal requirements for
flight, or refusing to accept voluntary or overtime flying, and to cease and
desist all such activity and to cease and desist all exhortations or
communications encouraging same, upon pain of fine, suspension, or other
sanction by USAPA;

IMHO they were idiots for putting that in there. I hope they get it.

Do you think you east guys can do $80 million or 120 million (after the synergies) worth of damage to force Parker to give you a contract? Nope he is going to be in court just like he is and the judge is going to slap usapa hard. Because Cleary had nothing else he wasted the one shot at putting pressure on the company at the very end to put the contract over. Cleary acted like a school boy on his first date. He fumbled around and got excited way to fast and way to early, heck he did not even get to first base. He has nothing to show for it and no one is satisfied. I agree with much of your post. I don't agree with the part about the judge slapping USAPA. Explain to me how the judge will tell them to make sure Captains taxi faster and don't write up maintenance discrepancies? See my post #515.

Go ask the UA Pilots and Mechanics, go ask AA's Pilots and the former NWA Mechanics about Judges, Courts, TROs and Injunctions.

The company has deep pockets and lots of resources and filed DOCUMENTED proof of the increase of write ups, and slower taxi times.

You guys are your own worst enemies, everything you do on the plane is recorded and documented and the company has done their homework, what has Cleary and USAPA done except waste your dues money on pipe dreams?
