Dude....you REALLY have to stop quoting Blomgren.  It shows exactly how desperate you are.  Dave's not one of my favorite union volunteers for a variety of reasons.  The same Jeff Freund argued BRILLIANTLY in front of the BOA as to why the Nicolau list should be the starting point AND the LAA guys opined THE SAME WAY.

The PHX Reps are complaining that there has been no movement and in fact, the opposite is true. They were warned many times by many people that by refusing to negotiate with the East over Nicolau and insisting it would be Nicolau or nothing, they got nothing. Five attempts to negotiate with them over the years resulted in telling us in essence, "Go to hell." Now they complain that they have been left behind.

Parker and Kirby told them that without the East merger, they would have implemented the plan "Zanzibar," within 2 weeks entered bankruptcy, furloughed 20% of the pilots and most likely liquidation shortly after that since they had no money and no prospects of getting financing. So by merging, they now fly 24% of former East flights. They should be grateful for the opportunity of merging with an airline that was profitable.

Dude....you REALLY have to stop reposting court documents, dicta, and briefings.  It shows exactly how desperate you are.  Freund's BRILLIANT argument will probably result in more wasted AOL donations, whooopeeeee. And you guys REALLY need to stop pointing out the APA's pseudo-agreement with a NIC-based proposal, if for no other reason than they are REGRETTING that they did so   They might soon learn what the average, reasonable, normal good-guy AWA pilot should have figured out by now: Following Ferguson and a bunch of other guys hired by America's Worst Airline into the legal abyss isn't worth it.

. The West Committee Proposal is plainly inequitable to East Pilots. It asks the Board to do what every court hearing the complaint of West Pilots concerning the Nicolau Award dispute has refused to do and which McCaskill-Bond prohibits the Board from doing -- to impose the never implemented Nicolau Award ISL.

What YOU think is "fair & equitable" does not matter. There is nothing that prevents the BOA from delivering a list that utilizes the Nicolau Seniority List as the beginning point for the LUS pilots. In fact, 2 of the 3 parties insisted on it.
