US Airways Pilots Settle Lump-Sum Pension Fight For $5.25M

Law360, New York (April 27, 2015, 6:57 PM ET) -- A D.C. federal judge on Friday approved a $5.25 million settlement between a group of former US Airways Group Inc. pilots and the airlines pension plan trustee over accusations it takes too long to hand out lump-sum benefits, six months after the judge revealed that a deal was in the works.
U.S. District Judge Rosemary M. Collyer signed off on the deal about 10 months after the D.C. Circuit reversed the judges denial of class certification. Collyer first hinted at a possible settlement in October, when...

PIC Update - Court of Appeals Decision

Dear Pilots,

We received very disappointing news yesterday. Our case USAPA vs. PBGC was turned down in the appellate court. (Click here to view the Judgment.) The committee and the attorneys have spent six long years working at getting this travesty brought to light and justice done. We are surprised that this case was decided so quickly, originally being told we'd not hear anything until summer.

Unfortunately, this is the end of the litigation side of the investigation and the committee. Members of our former Government Affairs Committee, serving as an APA GAC Ad Hoc Subcommittee, continue to pursue some measure of redress regarding miscalculation of benefits by the PBGC, utilizing political means.

It gets pretty quiet when you guys get shot down. We'll be wearing Liberty ties to the Crew News on Friday. Above gate A-8, T4 @ 10:30 am. Be sure to invite Borman, Diorio, Nelson, Music and Frear. Leonidas has some papers they have been trying to avoid.

The amount of hours logged by one vastly exceeds those of the other. The military loses 50 a year.(old number and may not be accurate today) Too bad they don't have any Cactus pilots. God bless you and your wonderful talent!

Did EC get it wrong? I thought it was our job to get our passengers safely from point A to B.

I'm proud to see America West had the talent. So much for meaningless challenges by a blowhard
like Eastus.

What is your plan for legacy AA furloughed? Will you attack the safety record of LAA when they fight your plans?

Our plan is to present the arbitrated seniority list to arbitrators. I certainly can defend the Cactus safety record. You have a problem with that?

USAPA's Constitution expressly provides that, upon dissolution, [a]ll [USAPA] assets shall
be liquidated and, less any indebtedness, shall then be prorated to the active members of good
standing of USAPA as of the time of such dissolution. Ex. 1 to Compl. at Art. I, § 3(A). Seeing
to it that monies that should not be spent are available for return to its members upon dissolution
is decidedly a remedy serving the unions express constitutional purposes. By its plain terms, the
USAPA Constitution mandates that, upon dissolution, the organization must disburse its remaining
treasury funds to all members, meaning both East and West Pilots. And it is this provision of
USAPAs Constitution that Plaintiffs here seek to enforce.
13 To the extent Defendants argument is that the West Pilots private fundraising puts them on
equal footing with Defendants and the East Pilots in their ability to finance the seniority integration
process, that argument is equally frivolous. There is simply no comparison between the use of
literally millions of coerced dollars collected from pilots as a condition of employment and the
voluntary donations by some well-intentioned West Pilots who have also been subject to the
obligation to pay dues to USAPA to keep their jobs. Put another way, Defendants are forcing the
West Pilots to pay twice: once through the West Pilots mandatory dues paid to USAPA, which
Defendants are keeping and using against the West Pilots, and second with West Pilots voluntary
fund-raising to get them the fair representation that USAPA and Defendants have denied them for
eight years.
Defendants argue that their ability to prosecute the seniority integration will be compromised if
they are precluded from using USAPA funds for that purpose. But that argument gets them
nowhere. First, as we have shown in Part B.2, above, USAPA has access to the same share of $4
million that the West Pilots have access to for seniority integration purposes. Second, Defendants
can do what the West Pilots have done for years (and continue to do today) and solicit voluntary
contributions from their pilot group to fund these activities. Finally, in any event, executing on a
bond in the event it is later determined that funds could be spent on seniority integration matters
would be entirely unnecessary because, if the injunction is ultimately lifted, Defendants will again
have access to the funds themselves and will not require resort to a bond for this purpose at all.
If, and that is a big if, if the courts ever rule USAPA has to give money in this lawsuit then you do know that Marty will get it all. All of it.

Marty is desperate for a win on anything, anywhere, from any court, so he can finally catch the pot of gold he has been chasing at the end of the rainbow.

america west pilots seek to take positions 17 yrs ahead of their hire date, west pilots take jobs of Australian pilots, west pilots agree to bottom of barrel contracts for decades. west pilots have no pension, cheer when others lose theirs. A sad legacy.
What are your plans for furloughed Legacy American pilots? It is a closely guarded plan, for it will awaken the LAA pilots to the threat to their careers PHX pilots pose.
