West Merger Committee Update

Following a morning of closed, off-the-record discussions between the SLI arbitration panel and the remaining parties to the process, the arbitration panel convened oral arguments this afternoon to decide the following questions:

1. Whether APA should engage in best efforts to establish a new merger committee to represent legacy U.S. Airways East pilots ("East Merger Committee")?

2. Whether a new East Merger Committee, if any, should be deemed bound by the Ninth Circuit's decision in Addington?

3. What shall be the revised schedule for the ISL hearing (including, without limitation, the schedule for establishing a new East Merger Committee, if any).

Our position is that the arbitration panel has no authority to answer question one and two. However, should the panel decide to answer those questions, our position is quite simple and unremarkable: we believe that the process should continue to move forward per the written agreement of the parties, and there is well settled law providing that arbitration proceedings continue unabated in the event one of the parties voluntarily withdraws. We encourage you to read the transcripts and briefs requested by the panel (which will be submitted by midnight tomorrow night, July 1, and will be posted on this site) to become fully informed of our position, as well as the positions of the other parties (American Airlines, Allied Pilots Association, and AAPSIC). The panel will render a written decision on these questions no later than midnight Monday, July 6.

At this time, the remaining July hearing dates, commencing Monday July 13, as well as the September and October hearing dates remain intact. The arbitration panel has also reserved the first two weeks in January on their schedules in the event additional hearing dates are needed.

We will continue to keep you updated as events continue to transpire.

Thank you for your continued support.

Sincerely,

The West Merger Committee

I wasn't here, but I was raised in an IAM household and had a grandfather who was in the UMWA and they taught me about true unionism, not the crap we have around here.

I agree, I was a 20 year IAM member and we always went by DOH in a merger.

APA Seniority List Integration Arbitration Update

The parties met again with the seniority list integration arbitration panel today. Yesterday, counsel for the USAPA Merger Committee indicated by letter that the committee elected to permanently withdraw from the proceedings. As a result of the USAPA Merger Committee's apparent and unprecedented decision not to participate in the SLI process, the remaining SLI parties submitted and argued the following three questions to the SLI panel:

Should APA engage in best efforts to establish a new merger committee to represent legacy US Airways East pilots ("East Merger Committee")?
Should a new East Merger Committee, if any, be deemed bound by the Ninth Circuit's decision in Addington?
What shall be the revised schedule for the SLI hearing (including, without limitation, the schedule for establishing a new East Merger Committee, if any)?
The panel has committed to rule on the above three questions by midnight July 6.

No additional SLI hearings or meetings will be held this week. As of now, hearings are still scheduled for the week of July 13-16, but that week may be affected by the panel's decision on the above questions. The Seniority Integration Protocol Agreement was entered into by and between APA, USAPA, American Airlines and US Airways. The Protocol Agreement set forth the agreed-upon seniority integration process and was agreed by all parties to be consistent with McCaskill-Bond. Under the Protocol Agreement, APA may not "interfere in the deliberations and decision making of the Merger Committees," including filling of vacancies on and selection of counsel for a merger committee in the event individual committee members or counsel need to be replaced.

Also, in light of the Ninth Circuit's decision, the AA Pilots Seniority Integration Committee withdrew its pre-hearing position statement, proposed integrated seniority list and other pre-hearing submissions, reserving the right to re-file after reviewing and considering how the court's decision may affect its position and presentation.

Transcripts for yesterday's on-the-record portion are posted on the SLI page of alliedpilots.org. Today's transcripts will be posted once received.

APA will continue to post updates as soon as additional information is known.

2018 is the new integration date according to Parker.

Get a life. The ones hired after you got canned do a great job. Doug Parker and his West philosophy is great.
