"INTEGRITY"?  My schedule showed the next childish rantings were supposed to be about "SOLIDARITY"...or was it "Karma"? Aw nuts. Now I've got to get a whole new calender.

Huh. I keep telling people how you reach into the "checkered" past of AWA, fishing up old videos, etc.......

Perhaps a more contemporary one fully demonstrating cheerleading zeal for management and an eager desire to see an injunction placed against the pilot group would better serve, although it's a true pity that the video of your Johnny M. obsequiously groveling and squirming at management's feet while directly asking the CEO about how he "should turn in" other pilots is company property that's not for public use, since that one alone would tell anyone all they need to know of your fine group:

When SPINTHIS goes away, the triumverate of Eastcheast and Cactuspilot1 miraculously falls apart.
Dave seems to be half in the game, all by himself.

This one will be around forever. 2011 it was made. The fishbowl was slowly being filled.

the western front seems sort of quiet the past few days, did someone whiz in their cornflakes?

David Braid, West Pilot pontification;

•Have reached the end of our good humor and polite disposition

Of late; the sad situation seems far worse than that even: "In the meantime, PHX is lost forever and we can't imagine how management will ever regain our trust. ....

Sincerely,

John Scherff
Eric Ferguson"

As truly tragic as all that seems, one "might" (however improperly of course) imagine the company's actually none-too-concerned about the loss of their PHX "useful idiots" otherwise eternal "trust" or even the "threat" of their having "reached the end of our good humor and polite disposition"....

Management has successfully sold it's pilot contract for many years to come, and hasn't the slightest immediate or even foreseeable need for mindlessly supportive sycophants and potentially eager Scabs, so PHX's previously useful idiots are at best now merely a minor annoyance. Oh well. Perhaps the "Next on Weekend update, the true meaning of INTEGRITY" will set all things right for them once more?

It turns out that "Doug" violated their child-like, innocent "trust" and isn't really their first-name-basis/Best-Friend-Forever after all. It almost even seems as if he doesn't at all care about their proud AWA heritage and mindless loyalty. Permit them a proper period of mourning from those shocking revelations.

Parker seemed disgusted with his PHX Townhall group. Between the weirdo in the poncho and that creepy Steve Gay, he had to have been facing a dilemma every time putting the film up in a company venue.
Scott Kirby seemed to enjoy wizzing on them.

The 9th explicitly said it wasn't final or binging on anyone.  Let's see if Silver can invent something better than that.

WRONG, in fact another LIE.  Here's what the 9th said LIAR:

We do not address the thorny question of the extent to which the Nicolau Award is binding on USAPA. We note, as the district court recognized, that USAPA is at least as free to abandon the Nicolau Award as was its predecessor (HINT: Niether ALPA or USAPA were "free" to abandon a FINAL & BINDING agreement), ALPA. The dissent appears implicitly to assume that the Nicolau Award, the product of the internal rules and processes of ALPA, is binding on USAPA.

Ninth Circuit Court of Appeals Opinion

Case: 09-16564 06/04/2010

So, AGAIN, they don't address the thorny question (back in 2010).  NOW, USAPA has been found GUILTY.  It will be remanded to Judge Silver (unless USAPA wins an enbanc plea).

AN OLDIE, BUT A GOODIE...

“Of course, in negotiating for a particular seniority regime, USAPA must not breach its duty of fair representation. Accordingly, if USAPA wishes to abandon the Nicolau Award and accept the consequences of this course of action, it is free to do so.  By discarding the result of a valid arbitration and negotiating for a different seniority regime, USAPA is running the risk that it will be sued by the disadvantaged pilots when the new collective bargaining agreement is finalized. An impartial arbitrator’s decision regarding an appropriate method of seniority integration is powerful evidence of a fair result. Discarding the Nicolau Award places USAPA on dangerous ground.

Judge Roslyn O. Silver, Chief United States District Judge

No. CV-10-01570-PHX-ROS ORDER; October 11, 2012

ONE OF MY FAV'S........

“Actually, it is USAPA that is needlessly delaying the resolution of the seniority dispute and jeopardizing the enforceability of the agreement the parties are able to reach. …….The arbitrator’s decision was to be final and binding on both pilot groups and was to be accepted by the Company so long as certain conditions were met.  The Nicolau Award has resulted in four years of litigation including a trial in federal court and jury verdict fining USAPA’s proposal for a non-Nicolau list to constitute an unlawful breach of the union’s duty of fair representation….”

Paul D. Jones; Vice President – Legal Affairs and Chief Compliance Officer

Exhibit 1 of  Declaration of Counsel; Case 13-15000, 02/20/2013

“….The Court’s patience with USAPA has run out.  USAPA avoided liability on the DFR claim by the slimmest of margins and the Court has serious doubts that USAPA will fairly and adequately represent all of its members while it remains a certified representative.  But all the Court can do at this stage is implore USAPA to, in the words of CAB, “make every effort to see that [the West Pilots’] are given extensive consideration, and that their interests are fairly and fully represented” during seniority integration…”

Judge Roslyn O. Silver, Chief United States District Judge

Case 2:13-cv-00471-ROS   Document 298   Filed 01/10/14

Gee.  If the case is ultimately remanded to Judge Silver, I wonder just how she view her duty to the harmed party?  I wonder if we could gleen an idea from what you fellas deemed as useless dicta?  Things that make you go hmmmmmm......

Hey cb53. You're  good at quoting things . Can you show us where the west was guaranteed that you would keep your rigs until final integration? I've asked several people with no, or vague response. Thanks.

Funny.  At the PHX union (you know, a REAL union) meeting, the company guest espoused how very pleased he was with Phoenix's preformance and professionalism.  While Phoenix may be a "fishbowl", he still holds our record of performance and safety in high regard.

It's funny that you keep referring to Parker & Kirby at crew news events.  Largely, we have stopped attending those for a miriad of reasons.

Keep smiling.  It will make the pain that much more bearable.
