"4 While enjoining the USAPA Merger Committee from participating in the McCaskill-
Bond seniority integration arbitration, except to the extent that it advocates the Nicolau
Award, the Addington majority recognized that, given the requirement of a ratification
vote by all pilots for any joint collective bargaining agreement, it was unclear whether the
Nicolau Award would have been implemented fully but for USAPA’s actions. Further,
the court expressly declined to order that an unmodified Nicolau Award be used to order
the seniority of the East and West pilots in the arbitration."

The following is west pilot braid quotes on the effectiveness of USAPA ;;

In January 2007 page 7 of the Nicolau award are the staffing numbers
Using a weighted average the West staffing number was 12.48
Current West positions 1333 and 122 aircraft.
Current West Staffing level 10.92
If the West had 2007 staffing levels we should have 1522 positions
The West is at least 189 pilots short. Not including the E190 or 757 seats"
 
"Separate Operations
•Separate Operations was supposed to be for a short time, not nine years.
•It does not mean that everything goes to the East pilots until the company finally decides to share something with the West.
•Some East employees don’t know or consider that PHX is part of US Airways.
•Managers have told new hires that they are lucky to be on the East list because PHX will close
•It has become institutionalized within the company that all new hires, new aircraft, new flying and all benefits go to the East.
•USAPA is going to do everything it can to continue separate operations, delay single carrier and keep taking those benefits for East pilots as long as someone from management keeps giving them the flying.
•The East pilots have no incentive to integrate with 20 new hires every month for the East
•Why would the East pilots want anything changed?"
 
"Low Staffing Point
•The West furloughs were sudden and much larger
•Furloughs not returned until 2014 never getting back to the staffing we started with before the furloughs
•The West was cut 300 pilots from July 2008 to January 2011 continuing to lose pilots far beyond the 150 furloughs
•Reaching our low point of 1264 pilots from 1661, 2007 baseline.
•From the East low point they have added 491 (19.6%) pilots
•From the West low point we have added 69 (5.4%) pilots"
 
"West Captains
•Since 2007 West Captains have had ZERO opportunity for advancement
•The number one West Captain, Ellis Ferris after nine years is still denied access to any wide body aircraft
•Including (13) A330’s added after the merger that were to be shared
•Over 180 Captain positions directly transferred from the West to the East
•Captains that were on reserve in 2005 are still on reserve, working weekends and Holidays
•There have been no upgrades and the number of West Captains has shrunk
•Instead East pilots have been given these opportunity."

The Nicolau list is still to this day the only accepted seniority list covering all LLC pilots.
 
And of course USAPA=SCAB

However it will never be used, it's a relic son.

So....if a pilot is listed on a "master scab list" via Continental, does that make him more of a scab than the pilots listed in the Ansett situation? What a RAY of sunshine you are, buddy.

My thoughts? It will be finished, and you will eventually get exactly what you are due. Former AWA pilots remain on legal & moral high ground. Have a great night, sir.

PS: You really needn't ask our thoughts over and over. We remain staunchly firm in our defense.

Your latest bid result, increase or improvement since USAPA was voted in?  Your thoughts please sir?
 
If you ask a west pilot what they have gained by their millions of dollars of legal fees, they will say they kept DOH off the property.
 
west pilots, sans the soon to be extinct phx base, DOH is alive and well in the CLT, PHL and DCA base since April, 2008. Proof positive is East new hires bidding Captain and wide body positions. 
 
Your feeble attempts to put lipstick on your pig, has been proven to be inconsequential.
