Fellow Pilots,

Yesterday, August 24, we received news that the 9th Circuit Court of Appeals has refused to hear USAPAs request for an en banc session where the case would be heard before all the judges of a court. (Click here to view the Order.) The only avenue remaining would be an appeal to the Supreme Court of the United States, which is under consideration.

USAPA will be defending itself against what we feel are extraordinary claims of attorneys fees and unspecified damages arising from the recent filing in North Carolina. The last amended complaint was for unspecified damages to be proven at trial, and to date, USAPA does not know what that will entail.

The USAPA Officers will continue to focus on the constitutional responsibilities to the membership, and the efficient resolution to all outstanding legal issues.

Judge Tosses Pilots Union RICO Suit Against Rival

A federal judge has dismissed a suit filed by a union representing pilots at U.S. Airways Group Inc. against a rival pilots' group seeking damages for violations of federal and state racketeering laws in the wake of the 2005 merger of U.S. Airways and America West Airlines.
Judge Martin Reidinger of U.S. District Court for the Western District of North Carolina ruled on Friday that the U.S. Airline Pilots Association's case against AWAPPA LLC did not meet the standards of the federal Racketeer and Corrupt Organizations Act.

Not getting the message the first time around, appealed and lost again. Too bad, _ _ _b Cleary.


Fourth Circuit Court of Appeals in Richmond Affirms Dismissal

Today the Fourth Circuit Court of Appeals in Richmond, Virginia, issued its ruling on USAPA's appeal of the dismissal of its lawsuit brought in 2008. USAPA filed the suit, alleging violations of the RICO Statute, against certain pilots who were alleged to be engaged in an overt attempt to deny all US Airways pilots their right to collectively bargain by attempting to destroy our union and performing other harmful and destructive acts to disrupt the unions ability to perform its representational responsibilities. The appeals court today affirmed the dismissal.
