Remember clowns, according to ya'll the Nic is dead!!!  ROTFLMAO

So, why are you deathly afraid of the next arbitration???

Idiots!!!
Looks like another delay.  No ANnuAl St Nic is coming mantra from you since the SLI arbitrations will not start till January 2016.

Spending yet more "quality time" with yourself in Fantasyland I see. Make whatever continued excuses for yourself as you feel needed to maintain some comfort, but equally excuse me while I just shake my head and laugh. 😉

Again for your case: A presumably overly-protective mother was likely a factor. No matter. You may now resume coiling up and pitifully hissing from beneath your keyboard kid.

P.S. Speaking of coiling up and pitifully hissing from beneath your keyboard: Whatever happened to good ole' res judicata?
Rumor has it he is trying to get another FBI interview. It is not going very well for him unfortunately.

No one is more natural, playing the woe is me victim status like the west pilots.

We are great Spartan Warriors, but we are victims too!

Personal responsibility?  west pilots are not the example in using such theory of evolution.

Darwin's theory would be more appropriate in using the west pilots as a case study.

Maybe you should have kept your job at the IRS, then you might know what true desperation is. And the NIC is dead, how is it fair to the 10K legacy AA folks to advance you on the NIC?
East is not afraid of the next arbitration; that's why there are three arbs there now. Do you think they realize that?

When you make a post like that and call someone an idiot you must realize how that makes yourself look right? You are the one in the fishbowl, how about give us another of your famous countdown clocks. Make sure it's water resistant next time.

The top ten misconceptions of the west pilots.

10   Wearing a 675 dollar tie will repel the reality of any situation.

9     Jumping up to 17 years of other pilots tenure is a good thing to have as ones epitaph.

8     Andersons letter to Judge Silver is an incorrect subject matter.

7     west pilots thinking they are as good as other professional pilots.  (See number 8 above)

6     west saved the East pilots.

5     west saved the Legacy American Airline Pilots

4     The  court costs of the Addington Appeal will only come out of the East Pilots share of a union refund.

3     west pilots will be flying LAA and LUS airplanes and routes in less than 5 years.

2    west pilots are making sense on the APA board, telling APA pilots get over it.

1    The nic award will be used by the current MB SLI Arbitration Board.

“…The Arbitration Board conducts an evidentiary hearing, with witnesses, evidence and a stenographic transcript. The Board’s Opinion and Award are to be issued simultaneously, within 150 days following the PID, unless both pilot groups and ALPA’s President agree to an extension. The Merger Policy provides, “The Award of the Arbitration Board shall be final and binding on all parties to the arbitration and shall be defended by ALPA.” No ALPA seniority integration arbitration result has ever been set aside by the courts although some dissatisfied pilots have challenged the award before administrative agencies and the courts.”

US Air Merger Committee Members: Todd Cardoza (PIT), Mike Cleary (BOS),Randy Mowery (PIT)

Emphasis added for the integrity-impaired.  You're thoughts, sir..

The Board shall retain jurisdiction in accordance with Section H. 5 .b. of the ALPA Merger Policy to resolve any disputes over the meaning or interpretation of this Award. This retention of jurisdiction shall terminate when all provisions of the Award have been satisfied. In the event the Chairman becomes unavailable or unwilling to serve to resolve such disputes, the Merger Committees will agree on a replacement Chairman or will select one by the alternate strike method from the most recent ALPA list of seniority integrations arbitrators.  In the event one of the Pilot Neutrals becomes unable or unwilling to serve on the Arbitration Board to resolve such disputes, the Chairman, after consultation with the Parties, shall decide how to proceed.  In any such arbitration, if there is a dispute between the methodology contained in the Award and the accompanying Integrated Seniority List or any other list purportedly using such methodology, the Seniority List prevails.

George Nicolau, Mediator

AWA/AAA Opinion & Award; May 07, 2007

“Of course, in negotiating for a particular seniority regime, USAPA must not breach its duty of fair representation. Accordingly, if USAPA wishes to abandon the Nicolau Award and accept the consequences of this course of action, it is free to do so.  By discarding the result of a valid arbitration and negotiating for a different seniority regime, USAPA is running the risk that it will be sued by the disadvantaged pilots when the new collective bargaining agreement is finalized. An impartial arbitrator’s decision regarding an appropriate method of seniority integration is powerful evidence of a fair result. Discarding the Nicolau Award places USAPA on dangerous ground.

Judge Roslyn O. Silver, Chief United States District Judge

No. CV-10-01570-PHX-ROS ORDER; October 11, 2012

"Oh, that?  It's just meaningless dicta!"  - Claxy Boy

“….The Court’s patience with USAPA has run out.  USAPA avoided liability on the DFR claim by the slimmest of margins and the Court has serious doubts that USAPA will fairly and adequately represent all of its members while it remains a certified representative.  But all the Court can do at this stage is implore USAPA to, in the words of CAB, “make every effort to see that [the West Pilots’] are given extensive consideration, and that their interests are fairly and fully represented” during seniority integration…”

Judge Roslyn O. Silver, Chief United States District Judge

Case 2:13-cv-00471-ROS   Document 298   Filed 01/10/14

And the "dicta" hits just keep on rollin'!!

A personal favorite of mine:

“Actually, it is USAPA that is needlessly delaying the resolution of the seniority dispute and jeopardizing the enforceability of the agreement the parties are able to reach. …….The arbitrator’s decision was to be final and binding on both pilot groups and was to be accepted by the Company so long as certain conditions were met.  The Nicolau Award has resulted in four years of litigation including a trial in federal court and jury verdict fining USAPA’s proposal for a non-Nicolau list to constitute an unlawful breach of the union’s duty of fair representation….”

#11 The West thinks that their new houses in CLT (and the associated difficulty in commuting back to PHX) will garner sympathy from the BOA, especially since they have been commuting for several years now.

#12  The West thinks there is no way they could ever experience furloughs again while the other pilot groups experience hiring to replace the retirements.
