It appears that amfa has been busted, as it were. We all knew that amfa's tactics were unconventional, intimidating and rather poorly thought out, now it appears that they are illegal!!!! This letter came out just hours ago.
Now, any of you wannabes want to condone such action by amfa.......
April 26, 2004
TO: All TWU Local Officers
The National Mediation Board (NMB) is in the process of determining whether
AMFA has submitted the required number of authorization cards to get a
representation election. Should the NMB rule that AMFA has sufficient
cards, an election is likely to be scheduled this summer.
On April 22, 2004 both the TWU and AMFA filed objections to the Company's
list of eligible voters. After reviewing AMFA's submission to the NMB, it is
clear that for the past year, inside managers at American Airlines have
provided AMFA with access to confidential payroll and personnel records for
our members. This explains why we have received hundreds of complaints from
individuals who never provided their home address to anyone except the
Company, but have nevertheless received several mailings from AMFA.
It is clear that access to this information originated with AA Management
and given to AMFA who used Company resources and facilities not for Company
business, but rather to assist AMFA’s organizing drive. In doing so, they
also compromised the privacy and security of thousands of AA employees.
So there is no misunderstanding, no TWU official has access to these inside
payroll and personnel records. For those of us who are American Airlines
employees, it would violate Rules 29 and 34 to access these records for the
purposes of this representation dispute without specific authorization from
the Company.
Because AMFA was supplied with Company records that were not given to the
TWU, AMFA has been provided with an unfair advantage in the current
representational dispute. Therefore, the TWU will request that the NMB
intervene to stop the Company from providing AMFA with access to all
confidential payroll and personnel records. Without swift action by the
NMB, AMFA will continue to use these records to unfairly influence its case
before the NMB, as well as any future election.
The TWU may also ask the NMB to establish a level playing field by providing
us with limited access to the same confidential records that have been given
to AMFA. If we are granted such access, I assure you that all information
will be handled in accordance with procedures that will protect confidential
records.
Sincerely and fraternally,
James C. Little
Director Air Transport Division
Intl. Administrative Vice President
Come on now.....we are waiting for an explanation to this one!!!!!
