When APA files for Single Carrier they could care less about fighting for your Change of Control in court. In fact, if that would derail their efforts to get their furloughed pilots back to any seat in any domicile, you can be sure they will ignore it.

So if you base your whole exception to the MOU over losing CoC. remember, you'll have to finance your own case while paying APA to fight you.

You'll need some mechanism for raising funds and hirnig lawyers. The name Leonidas has already been taken.
