Outstanding turn out today. Great show of support for the west class insuring that the Nicolau will be the seniority list used. Yes everyone has and continues to open our wallets. Got a little briefing on the money situation. Doing just fine thank you.

Questions asked and answered. After listening to ALL of the possibilities unlike usapa's one sided arguments I can say that I am not worried in the least about what list will be used for the arbitration.

You mean like: The union that is supposed to represent us, offers up the west as a sacrifice to get what they want? It would not surprise me if some of them were trying. I think the APA is smarter than that. They have better things to do with their money than make the lawyers rich and face the monetary consequences/damages down the line. Besides they're not going to plant 1500 pilots under them just to have 3000 move above them. Just my 1 1/2 cents.

Have you been paying attention? We voted. Our guys won. Your guys nullified the vote, created new rules so that we can't win, then reran the election. Then you have the gall to say that I am sickening for not wanting to vote? You guys are ingrates of the highest order.
 
What do you find insulting about listing the legal activities of USAPA and asking what has been produced in financial benefits to the pilots thus far?

I don't give Count 2 or Count 3 much of a chance in Silver's ruling on the DJ. How can she rule that a non-NIC list does not and would never constitute a DFR when this very matter came up in judge Wake's courtroom and the exact opposite was determined based on a review of the merits and was so rendered by an impartial jury? The Ninth said it was not ripe and that they intentionally avoided the thorny issue of reviewing the case on its merits in their chambers. So, how could Silver go so far as to render the a non-NIC seniority list as judgement proof subsequent to ratification (ripeness) based on the events and rulings in either Wake's or the Ninth's courtrooms?

As for immunity, what court is going to do that? Maybe the POTUS could grant immunity from future federal prosecution (if watching 24 taught me anything), but how can a court take away a private group of citizens' rights to assert a claim for breach of contract and a breach of DFR simply because one judge says so prior to the a single court filing on the matter? It's one thing to say that even if the feds had a case against US Airways that they promise not to pursue it, but the feds do not speak for the west pilots who can surely claim harm and have the legal right to demand that a court hear their future case if a non-NIC list is ratified.

So, if the DJ is ripe (and Silver said it was without question), then it would defy all logic for her to grant relief on either Count 2 or Count 3. That only leaves Count 1 (a non-NIC list is a clear DFR) or Count 4 which would be a solution no one has proposed as of yet. The latter is certainly a remote possibility, but my instinct tells me Count 1 has the best chance by far for being granted by Silver sometime this year. Time will tell though.

Bad idea sir....whomever eventually ran over the sad creature, not instantly realizing that they'd just improved the human gene pool a bit, might suffer entirely undue guilt from doing so 😉

This is my 16 yr old daughter, Rebecca. She is a team Captain for this year's 32 mile bike ride as a fund raiser for the American Diabetes Association.

She is actively seeking a cure for Type 1 Diabetes, having been diagnosed with the disease at age 7, and fighting that daily battle. Also, she participates in studies and donates blood regularly for research at the Barbara Davis Diabetes Research Institute in Denver. So she is not sitting around, waiting for someone else to solve this puzzle, she is on the front line. It's kinda cool that while she is giving blood for research, two stories up at the Research Institute, mice are actually being used, trying to find a cure for this disease.

Last year was her first try at this kind of fund raiser. I am proud to say that mainly through donations from East and West pilots, she raised over $11,500......she was the second highest individual fund raiser in the state of Colorado. Thanks so much!!! Of course, USAir coprorate would not donate a penny. It just shows that the human spirit is alive and well.

Understood. There are certainly far worse things to do than directly help other people...and I've yet to hear of cargo ever showing any appreciation whatsoever for it's safe transport 😉

Sounds like you are happy about that. Oh well, let's see what you have to say if you are working without your west good contract provisions. Don't choke on the popcorn.
I did not say I was happy about it. Just pointing out that from day one you east guys have screwed things up. Screwed it up when you were ALPA. Screwed it up when you are usapa. We are used to the east screwing the west. Don't expect anything different dealing with APA.

Beside usapa was going to give away the good west provisions anyway. I had come to terms with that a long time ago.
