If the company has failed to abide by the Nic (the status qou, in your estimation) then why haven't you sued the company for the damages of not abiding by the status qou? Oh yeah, ya did already. Refresh our memory on how that turned out. :lol:

The company was dismissed from Addington. I think the reason was because if memory serves, they told usapa to shove the DOH list and kept you idiots locked on that crappy contract and avoided the West section 6 request as well.

A direct result of scabs Bradford and Theurer's belief that the union busting lawyer was the DOH messiah, and they would be able to steal the West's jobs. Then scabs Mowery and Cleary took the ball and further entrenched the east in a decade worth of LOA93.

Your post are getting very smug for such an intelligent, way underpaid pilot on the five time lawsuit losing sided of the operation.

Hey, ya know what...the company got out of the status quo lawsuit, and the LOA93 arbitration, and oh...they won that work slowdown injunction though.

so, lets see where is the company today? Oh, that is right, they filled their own lawsuit seeking declaratory judgement so they don't get caught up in the exact same lawsuit on the losing(usapa) side again.
 
If they are abiding by it why did you sue them?

We sued them to keep them from negotiating seniority, it worked didn't it? Now tell me as of today what is the only accepted seniority list for the combined airline?

That's where we logically part company, as it appears quite clear to me that is simply not the case. Should any argue further that a snapshot at merger time is appropriate methodology...well...where does that truly leave us then?

So you are saying the ta is not reality? Where is the separate ops restriction? What document is in effect that keeps ops separate?
 
Why is the west afraid of a 3 way? Do they feel they received a windfall in the NIC and might lose it?

Doesn't USAPA represent ALL the pilots of US Airways? Let me guess, in reality USAPA represents the East pilots and the need of a three-way is to promote those interests while sitting at the table with APA.

Lets say I was completely broke, so I robbed a bank, made off with a couple million, and got caught.

If we then take a snapshot of my portfolio prior to trial....am I a multi-millionare, or an about to be broke convict?

The actual positions now occupied at LCC are a result of the seperate ops clause of the same TA that guarantees the Nic. Any current snapshot at LCC would be Nic inclusive.

Further, and I have stated this before, usapa and the east consider guys like Odell as furloughed. Completely false categorization. Odell and the other West pilots who are still not back on property are bypassing recall. A snapshot taken at LCC today of Odell's position would still place him one senior to Coello, exercising his contractual rights afforded again by his CBA and the TA.

Frankly, personally I am not afraid of a threeway if it could be done in a fair and equitable manner. i.e. the West is given an autonomous status in which to promote its interest. However, I do not think usapa would roll over and take the chance of the beating that could come from a threeway, and I do not know how the West could be given that status legally, or how you go about ignoring an NMB representational election.

Further, if it is determined that usapa is incapable of representing West interests, and the West is granted autonomous standing, that is an admission that usapa has been violating its DFR owed the West for the last 4 years.

Actually, the more I think about it, the more I would like to see a threeway.

Clear....I don't do flaps 3 even after they took over, unless an engine is shutdown or there is windshear.

We were talking about a callout anyway, not a flap setting. They just can't seem to get that through their heads I guess.

In any event, we all know where the company is today. They are in front of Silver asking what to do about their Hobson's choice of being forced to collude with usapa.

Yeah, I know, and you said who heard of "flaps 3, landing checklist"...implying it should be "gear down, landing checklist" and the reality of the situation is it goes like this.....

"gear down, flaps 3, landing checklist"...... and when I am flying it goes like this.."gear down, flaps 3, landing checklist...flaps full"
