Try and be a little more precise. Judge Silver did not say it had to be the nicolau but she warned usapa that you better have a damn good reason for not using the Nicolau. The company has said it is either the nicolau or a non Nicoolau. They are not saying Nicolau or DOH. Any change to the Nicolau is a non Nicolau. Using the Nicolau list and a single C&R is not the Nicolau and the company and usapa had better have a great excuse (LUP) and be ready to back the up in court that that C&R does not disadvantage the west.

The reason I brought Luv into was because he is the one that threw the BS out that the west did not have a DC plan until the east "generously" gave us one.

Yeah, I'll be the big man and admit I was wrong about something way back. When I was asking you about why you cared about the PIC I said something like "you didn't even have a pension." What I should have said was that you didn't have a Defined Benefit Pension. But, then I asked you a question. Here ya go:

"Did you have a DC plan or a matching 401k? Until the merger didn't you have to first contribute to your 401k and then the company matched up to 10%? And because of the merger, along with profit sharing that you didn't have, they gave you the 10% without you first contributing?"

How can I be wrong when I'm asking you a question?
