The West says that Nicolau implied that the company would probably "never" recall furloughed East pilots....

Doug Parker specifically said the company will probably "never" recall West pilots....

Indeed, a scenario that requires courts to afford a union a wide range of reasonableness... The courts win.

How about finishing that statement. Furloughed east pilots would never have been recalled without the merger. That means your UN MERGED expectation were never recalled.

Two entirely different situations.

The east NEVER recalled unless we merged.

The west should not even be furloughed except for the scumbaggery of the east.

The court is only going to be concerned about why the east is being scumbags and wanting to change a fair arbitration. To quote the court, Silver.

But since AMR will not be in charge I guess I don't have to worry. I will take my Nicolau seniority and bid a nice place somewhere else if Parker decides to shrink PHX.

It seems that it is your easties that are worried. How is the contract coming along? If I were you I would talk to Roland Wilder and have him explain about seniority and being the lowest paid pilots and having BK work rules during a merger. It does not go well.

If a joint contract (w/DOH) is ratified (and then the seniority section is blocked by a Judge {Wake, perhaps}) then yes, there would be no west or east to be recalled to. They would be recalled to the joint airline and await their placement on the Nic list.

Even fish in a barrel would understand that. It's the ones left to rot on LOA93 that are stinking up the place.
 
Since you're discussung furloughed pilots, I'd guess all of the Westies have written the APA and explained to them why all of their furloughed pilots should be placed on the bottom of any combined list.
Sorry you had to go through a furlough. So have many, many folks out west prior to and during their tenure at AWA.

The furloughed pilots weren't furloughed when Nic awarded their spot on the list. So their original Nic posiiton will be their starting place.

Now, concerning APA, they should integrate based on the M-B rules. But the east shall be held accountable for the damage their actions caused those furloughees, so those payments should ease the pain, somewhat.

Perhaps you should get off your lazy tail and get one yourself, or at least consider some educational pursuits meanwhile. Presumably playing Mr. Mom and whacking your "life" away on a keyboard isn't much the true mark of a "man"....just sayin'.
 
The South still has a large number of low education types that still nurse a little candle flame in hopes that the South will rise again one day, but even they don't think they will ever cash in on the Confederate bonds.

You are absolutely correct: The USAPAIAN faithful will NEVER be able to cash in the DOH lottery ticket. Pour souls......
