I am not so certain there is a need to negotiate "the nic". Why even incorporate into any paperwork, thereby, acknowledge, such a flawed piece of paper.

I would agree, there is absolutely no need to negotiate the Nicolau list simply because it no longer exists. The time for negotiations would have been up to and including the Wye River effort. Once USAPA won the election, overnight, it became a new ballgame.

It would seem that some pilots underestimated the need to negotiate the Nicolau list, they also underestimated the vote under the NMB. Those pilots lost the bet on both tables. And, today, we are where we are.
 
Would that be the malicious law suit that USAPA filed against 24 innocent west pilots?

They were found "not guilty"? You know better than that cleardirect.

Whether USAPA pursues legal recourse in state court remains to be seen. But that is really not the salient point here.

USAPA tried and tried to get these Leo-Wappa pilots to cease and desist. Up until the charges were filed they were unsuccessful. Today, all that highly inappropriate, unacceptable, unprofessional behavior has vanished.

I'd have to say, USAPA made its point, since they did in fact achieve what they were requesting - an end to the behaviors.
 
24 innocent west pilots my behind. Who cares what it cost pal? Just watch you guys on U-tube or the most recent meeting with Parker. I actually laughed on the last one with the "we hate you guys" comment. I rode J/S on NW and UAL the other day. I asked them if they were refusing any of the East guys. Guess what, NW said they would refuse a Westie before any East guy and the UA guy said we have other things to worry about. Keep pounding your drums. All of you Westies are allowed on my J/S anytime, I can handle the stress. :up:

Just a small clarification - there is only one group, not two. The vote will be done collectively as one group of eligible voters.

True. But sadly, under the leadership of AWAPPA and Leonidas, the West contingent has been encouraged to not involve themselves in USAPA, thus denying them a vote in acceptability of the outcome of negotiations with the company. Talking about stacking the odds against YOURSELF!

This board is too funny. It's just a bunch of over-winded Easties trying to convince themselves that they are right. Keep posting it provides great entertainment. Don't forget to throw the 'sighs' in there and the references to 'Saint Nic.' Hope I don't spend this much time on message boards by the time I'm pushing sixty. Aren't you old men supposed to be playing with all the toys those industry leading contracts afforded you?

There is one thing I will never understand and maybe an easty can help me with this. The majority of you are on the verge of retirement. If you don't medical out then on average you guys have maybe 7 years left. Yet you chose to spend those FINAL 7 years of your life's work toiling under a bottom of the barrel contract with Mesa type work rules while battling a final and binding award in court for WHAT? You aren't going to be around long enough to even come close to recovering what you gave up? Why didn't you take the extra 30-60k per year/ plus more vacation/ liveable work rules/ etc and run? Do you think you'll get anything in the way of decent retro pay now that we're USAPA? Will 6 months in the left seat of a 330 make up for 3-5 more years with a terrible contract?

Being treated FAIRLY will more than make up for any losses.

Those that continually wish to benefit at the expense of others, i.e. cash the lottery ticket, should be ashamed of themselves, selfish ba$tards! Maybe Kirby should have called it a "lootery" ticket, since that's what it would have amounted to.

PHL Domicile Update

Fellow pilots,

On Wednesday, July 16th we held our first USAPA Domicile meeting. The minutes of the meeting will be forthcoming but we feel that an update on some topics is needed.

Holding of the first PHL USAPA Domicile meeting was a monumental event, but an even larger unprecedented event in our pilots' history also took place while our meeting was in session. On the 16th of July, while our meeting was in progress, two of our fellow pilots were put at the “tip of the spear†and ordered to submit to a “training†session in the simulator on “Fuel Conservation.â€

When we first were informed of this “training†session, we had and still do have, very strong objections. It is not covered in our contract, the AQP protocols, or any syllabus. We were told that we would be provided a syllabus for this individualized “training,“ but not until the hours of the evening before were we provided with this document. Thus, these pilots had little way of knowing what to expect and no time to prepare for their upcoming event.

That’s what was said and this is what was done!

We believed that we had an agreement with the Company that these pilots would be afforded the right to have a USAPA Representative present at their “training†event. However, at the 11th hour, the Company mandated that we sign a non-precedent setting waiver to our agreement to allow pilot representatives to observe these eight pilots' “training†sessions. This would have set a new precedent that would potentially disallow any representative from ever observing any future training event. Your union declined to sign this letter, as we had been allowed to observe previous training events in the past. For that matter, in past practice during a “training†event, spouses, children and even friends were allowed to observe as long as all parties in the simulator were OK with them being there. On the 16th, when one of your Reps showed up to observe the “training†event, he was denied access to both the briefing as well as the simulator.

That’s what was said and this is what was done!


This event consisted of a one hour brief, followed by a two hour simulator session. We were told that these pilots would be there to observe, and that in the simulator would be a Check Airman and an Instructor Pilot performing the demonstration. What actually occurred was that our pilots sat in the left seat and acted as the PM and did operate some controls. Some questions were asked and a lecture on airline economics was given.

That’s what was said and this is what was done!

A note about these Captains that have been called in at the point of a spear: These are fellow pilots and very senior ones at that. All they have done is to add more fuel to the gate release for any one of a thousand reasons. After all, they are the Captain of their aircraft and who better to know what is required to complete their flight in a safe and efficient manner? Unlike our management, it is:

What the Captain says and what the Captain does, matters!

Per the FOM section 1.3.4 the Captain has the final say and the operation will stop until he is satisfied.

We believe that this whole issue is about “Captain's Authority.“ Over the years we have seen that authority eroded and our contract become a joke and a non-issue to the Company. We have let that happen one small piece at a time. Now they are taking bigger bites. This will continue until we once again start reminding the Company that we are Professional Airline Captains.

Or do you want to be intimidated into getting out of the “green†and pushed into the “yellow†and “red†of the Company’s own Volant model and have your judgment and hours of experience be questioned?

Be a CAPTAIN and take command of your aircraft and carrier.

To finish our thoughts, look at what else has been said and what has been done. Mr. Parker said “yes, parity was the thing to do.†We’re still waiting! In the July issue of US Airways magazine from Mr. Parkers’ article, “An employee-fueled winning streakâ€, Mr. Parker states, “These kinds of results are indicative of the amazing teamwork and dedication of US Airways employees. It’s thanks to their hard work that we’ve become one of the most reliable carriers in the country. We think that recognizing our employees for focusing on what matters most to our customers - getting them to their destination safely and on time.â€

Mr. Parker has recognized eight of our most senior Captains for what matters most, getting our passengers to their destination safely, by subjecting them to a training session to intimidate them into reducing their margin of safety. What is next in line to challenge “Captain’s Authority?â€

USAPA Retirement and Insurance Committee Update
July 2008


The Retirement and Insurance Committee convened the week of July 14 to assist the Negotiating Advisory Committee and review the progress of our programs and the transition issues involved. The former ALPA Committee members have joined USAPA and have been instrumental in aiding the Negotiating Advisory Committee and R&I Committee. Transfer of Insurance programs with Harvey Watt are proceeding on track. Information from HW will be sent by the end of the month concerning billing and proof-of-coverage documentation. West Displacement Bid
Update​

The Company has notified the Association that after further review, the number of Captain downgrades has been adjusted to 138, the number of FO displacements lowered to 45 and the number of furloughs remains at 175. The timeline remains the same as well.

The new numbers are as follows:

138 CA Displacements

-25 B757 CA
-60 A320 CA PHX
-53 B737 CA

45 FO Displacements, 8 FO Vacancies

-18 B757 FO
-4 A320 FO PHX
-23 B737 FO
+8 A320 FO LAS​

175 Furloughs

Perhaps we could get some west pilots to step up to the plate and volunteer their time and experience for the benefit of all US Airways pilots, especially those based in PHX and LAS.

USAPA will only be as good as we make it. Please don't misunderstand this post; USAPA will be fine with or without your help. Your volunteerism, support and experience, however, will make it a better pilots' union. That's a choice each of us has to make.

US Airways CEO: "We'll get through the turmoil"


Doug Parker, in comments to the Philadelphia Inquirer's Editorial Board on July 20th, made the following comments:
"If there are other airlines whose strategies are based on US Airways going away, they'd better find a different strategy. We are going to be fine, and we are going to get through this. We can compete as well as anyone."

If that's not clear enough: "There is no imminent risk. We have thankfully done a good job of generating cash and saving it," Parker said.
