Very simple.
Ask yourself who entered into arbitration. The answere is the east pilots and the West pilots. Not usapa, not ALPA, not LCC.
Then ask yourself, who does usapa have the legal obligation (a DFR) to represent?
The Nic is the product of a binding arbitration between the pilots usapa represents. There is no after the fact ratification approval for either side.
On another topic, if usapa were to push for a three way, what lists would they use? There are no "ratified" three list as you claim. Who ratified that West furloughees would be offered recall to the east and vice versa? Oh, I know the same TA that specifies the Nic is the combined list. Further, passing three list, how does usapa then represent both the east and West in front of an arbitrator? which of the two list they pass do they favor? Really?? They go in front of the arbitrator and make the case of why pilots on the east list should go in front of pilots on the West list, then turn right around and argue why pilots on the West list should go in front of pilots on the east list......just exactly how would that work and not be a DFR failure?
Bottom line. usapa represents all the pilots at LCC. As affirmed by the 9th, they have to negotiate for all those pilots. Those same pilots entered into a binding arbitration in the seniority matter that produced the Nic. usapa has no alternative but to use the Nic as the combined list amongst the pilots it represents.
