Additional requirements like having an initial in the last few years. APA seems to argue in their response that the MOU is a CBA. If the MOU can be construed to be a temporary JCBA, then the other condition of the MOU has been met; namely, once a JCBA is in place, arbitration can begin. The sooner the better, before the NMB makes a determination.
