Legal Postings: Addington II, Appeal to the Ninth Circuit

This morning we received a decision from the United States Court of Appeals in Addington II, reversing Judge Silver’s decision on the duty of fair representation claim and remanding the case to the District Court to enter an injunction against USAPA. The opinion reads in part: “Accordingly, we reverse the district court’s conclusion that USAPA did not breach its duty of fair representation and remand with instructions to enjoin USAPA from participating in the McCaskill-Bond proceedings except to the extent that USAPA will advocate the Nicolau Award.”

The opinion and the dissent by Judge Tashima is now posted in the Legal Library.

USAPA is considering its response to the decision at this time with respect to the SLI Hearing and we will provide more information as soon as possible.

west pilots, it looks like you are not making any friends on the APA C&R forum.   johnny (Mr Parker the East pilots are burning fuel and not asking for direct routes, waaaah! accuser) mcllvenna sounds so desperate trying to inform LAA pilots that he is tired of saving bankrupt airlines and advising them "if you were 40 percent on a list at amr or west phx island, that is what you will be on the future combined list so get over it.'
 
2004 america west hire and former American Eagle pilot mitch vasalino is absent on the C&R forum after many posts acting like an expert labor atty using his 2015 law degree from a matchbook law school the last few months.  mitch is busy being part of the west sli committee.

It's not a slam dunk that the East pilots will get a new Merger Committee. APA asked for one, but it is up to the arbitrators to decide. If they decide against us, who will we blame for having no representation? Why did USAPA leadership send mixed signals when they said they may want to participate later? Does anyone really know what is going on here???

 
 

It is a slam dunk that the East pilots will get their own SLI committee in this process. 
 
If I had someone to blame for our weak spots it would be your waffling, limp wristed posts, advising others to give up and follow up saying by the way, I've got mine in Freudian slips.

Your thoughts please west pilots?  cactuspilot1 apparently had to leave hastily after I asked him that question twice. Perhaps he is out somewhere picking cherries.

So you are going to sue for collusion?  The west pilots are going to sue APA?  This will blindside them (sarcasm).    APA is very aware you will sue no matter what the outcome. This is why you have been on phx island, are on phx island and will remain on phx island indefinitely. 
 
There is an orchestra that has been practicing for the orchestration of future events.
