The bottom line:  The Ninth said that "USAPA has breached its duty of fair representation".  Further, they said: "..constitutionally committed to a date-of-hire list that favored the East Pilots, USAPA could never fairly and impartially represent the West pilots."
 
Finally they said: "We thus remand this case with instructions to the district court to enter an order enjoining USAPA from participating in the McCaskill-Bond seniority integration proceedings, including any seniority-related discussions leading up to those proceedings, except to the extent that USAPA advocates the Nicolau Award."
 
Now let's see if Judge Silver's "meaningless dicta" will now bite you in the backside.
 
USAPA is now on the hook for court expenses and perhaps damages.

.......That you'se thing really kills me East. I'm know, by intention. But seriously, can we agree it's ridiculous and sure sounds like a great way to negatively characterize an entire pilot group, but also understand that it clearly displayed that pilot's true frustration and disbelief that he had to stand up and confront a group so inclined to destroy him and his peers careers. I get it, as we all do, that it makes us look like what you want to believe true, but come on.

Thinking about it though, it would be fun to go aerial against another, and I can't believe I didn't realize that was the challenge from the get go. Just wish it was a hobby of mine that I could excel at and then challenge others to. Never too late I guess.

That pitifully drooling little "I hate all of you'se" infantile moron was just whining about how he "was going to be a captain", but apparently hadn't so much as even mastered much of the english language beforehand. I was almost expecting to see his presumably-overly-protective mommy show up to give him a comforting hug and wipe the frothy drool from his chin afterwards. Seriously; "destroy him"? Where does all the drama queen nonsense come from?
 
2) "Thinking about it though, it would be fun to go aerial against another," On a personal level; I'd think you an enjoyable individual to meet, talk and fly with/"against", but while you're working any attempted "defense" of your juvenile group: Suggested minimum wager's $5K, adjustable if desired to accomodate any fully designated and "Army" of leo-whatever's sanctioned representative of all "Sparta", of course. Once all this mess is finally finished I'd be fine to fly it purely for fun. Is the aerial nature of the wager "fair" on my part?...Arguably not, but I'm not trying to support the side that's bragged about what AWAsome "pilots" they supposedly are for 8 years now. To me a "Pilot" is a creature suited to swim in the sky at any depth.
 
No offense meant, but you honestly can't be at all serious with my wanting to make anyone "look" as anything other than they've so earnestly proved to the world themselves. Try explaining how such as the following was ever "intelligently" intended to demonstrate anything else to the world than childish narcissism and purely infantile idiocy?
