The courts and the arbitrators "get it", agreed.

12” We decline to order the issuance of the West Pilots’ requested injunction
“that an unmodified Nicolau Award must be used to order the seniority of the East
and West pilots in the pending McCaskill-Bond process.”

9th Circuit Court of Appeals

“4 While enjoining the USAPA Merger Committee from participating in the McCaskill-
Bond seniority integration arbitration, except to the extent that it advocates the Nicolau
Award, the Addington majority recognized that, given the requirement of a ratification
vote by all pilots for any joint collective bargaining agreement, it was unclear whether the
Nicolau Award would have been implemented fully but for USAPA’s actions. Further,
the court expressly declined to order that an unmodified Nicolau Award be used to order
the seniority of the East and West pilots in the arbitration.”

"We thus remand this case with instructions to the district court to enter an order enjoining USAPA from participating in the McCaskill-Bond seniority integration proceedings, including any seniority-related discussions leading up to those proceedings, except to the extent that USAPA advocates the Nicolau Award."

"To be clear, Plaintiffs neither object to APA appointing a merger committee for the
East Pilots nor to that committee participating in the McCaskill-Bond proceedings.
Rather, Plaintiffs object to the APA East Merger Committee participating in those
proceedings without advocating for the Nicolau Award. Given the rapidity after the Ninth
Circuit’s ruling by which the East Pilots dissolved the USAPA Merger Committee and
formed an APA merger committee, it is evident that the East Pilots intend that this
committee will not advocate the Nicolau Award. Plaintiffs seek an order that takes away
all question of whether they can do this."

Eastus1,

Is it true you got hired by psa in 1986?

After reading all your defamation of anyone hired at awa all these years I have to say I am astounded that this may be true.

Psa guys I've met have all been the most America west- like pilots I've ever been in contact with. Probably just the nature of geography and the resulting mindset and attitude of living in the west.

Funny how you knock a lot of us for the awa job.

When I was flooding the industry with my resume, only 2 were hiring. Swa and awa. It was just post 911 so the legacy carriers were not hiring anyone. I didn't have a 737 type swa was looking for, but awa was who called. I took it, more than happily as I lived in AZ.

I just find it funny you knock a group with taking the job as if to say they couldn't hack it at a legacy.

All the while, you did just that apparently. You chose to join psa for whatever reason, bypassing getting in your terms, a real job with a better carrier.

Is this true?

Wow, that's a low blow to the PSA guys, don't think any of them were scabs as far as I know

After the three committees spring out of their bottles (today?) and announce their positions to the BOA, who will scurry about chasing the genies to put them back in their bottle?

West Merger Committee Update

PUBLICATION OF SENIORITY PROPOSALS
Late this evening, September 19, 2015, the three merger committees will exchange the following information with one another:
1. Pre-hearing Statements of Position, including proposed seniority list integration methodology, and proposed integrated seniority list with accompanying Conditions and Restrictions.
2. Lists of proposed witnesses for the Parties' cases in chief.
3. Proposed Exhibits for Witnesses the Parties' intend to call in their cases in chief.
Although these submissions are due at midnight this evening, it is possible that we may not have access to them until early tomorrow morning, Sunday, September 20. We will publish these submissions as soon as they are available to us. The submissions will also be posted at the following web locations:
http://www.west-merger-committee.com
https://public.alliedpilots.org/apa/Home/SeniorityIntegration.aspx
During the arbitration hearings, these websites will also contain the daily hearing transcripts in addition to all exhibits and written submissions used in the hearings.
THE SENIORITY ARBITRATION HEARINGS
As a reminder, arbitration hearings dates are scheduled as follows: September 29 - October 2, and October 12-16, 2015 as well as January 4-8 and 11-15, 2016. Arbitration hearings for the week of September 29 - October 2 will be held at the Sheraton Pentagon City, 900 S Orme St, Arlington, VA 22204. The hearings will generally be open and pilots will be allowed to observe the hearings as space allows. Portions of the hearing however containing information and data subject to confidentiality agreements and restrictions may be closed to observers.
The hearings will begin on September 29 with opening statements from each party; the East committee to go first, followed by the West committee, and then the AA committee. Following opening statements, the parties will put on their cases-in-chief, known as "direct cases", in this same order. Direct cases involve each committee introducing evidence to the arbitration panel by means of witnesses and exhibits. The evidence is generally designed to support that committee's integration proposal, and each witness is subject to cross-examination by the other committees' attorneys. The direct cases are expected to last through October 16.
Following the direct cases, each committee will have the opportunity to present a rebuttal case. In the rebuttal, each committee will have the opportunity to introduce additional witnesses and evidence to respond to evidence and arguments that the other committees presented in their direct cases. The rebuttal cases will not begin until January 2016
Thank you for your continued support.
Sincerely,
The West Merger Committee

You cannot ask East Cheats a question so complex!
Reading the SLI briefs, it's not that complex. 😉

The Nicolau Award was the product of a fair and equitable SLI process that was binding on the East and West pilot groups, that has never been found to have been outside of the range of reasonable outcomes under the prevailing SLI standards governing that process, that was accepted by the Company as the seniority list that would govern US Airways pilots and that was not in effect at US Airways in advance of this merger only as a consequence of the East pilots exploitation of USAPAs breach of it duty of fair representation. The only fair and equitable starting point for this SLI proceeding and the only starting point consistent with the principle that the results of SLI proceedings agreed to in advance by all interested parties are to be respectedis the Nicolau Award

Haven't read though much of this but it sure looks like the LAA group has reworked their proposal to include the Nic award. Smart move.

This genie??? 😉

For the reasons discussed above, the AAPSIC then integrates the East and West seniority lists based on the Nicolau Award, to create a combined US Airways seniority list, to be integrated with the pre-merger American seniority list as of December 9, 2013

The bottom line:

PRE-HEARING POSITION STATEMENT OF
AMERICAN AIRLINES PILOTS SENIORITY INTEGRATION COMMITTEE

As discussed above, as of December 9, 2013, the East and West Pilots were working in
separate operations under separate seniority lists, with distinct pre-merger equities and career
expectations; and the Protocol Agreement contemplates that the ISL will be constructed from the three
separate seniority lists in effect as of that date. However, the AAPSIC recognizes the West Pilots
claim to the Nicolau Award; and that, under the circumstances, the relative placement of the East and
West Pilots on the ISL should be based on the Nicolau Award.
At the same time, since the Nicolau
Award has not been in place for the past nine years, implementation of an ISL utilizing the Nicolau
Award will require the rationalization of jobs as between the West and East Pilots, because many West
Pilots will be placed on the ISL in ranges giving them access to pre-merger US Airways jobs to which
they had not had access because of the failure to implement the Nicolau Award. That rationalization
of pre-merger US Airways jobs should occur as between the East and West Pilots, and should not
adversely impact the pre-merger American Pilots, who are innocent bystanders in the long-running
East/West standoff. The AAPSICs proposed ISL and Conditions and Restrictions take all of these
considerations into account.

Conclusion

For the foregoing reasons, the AAPSIC submits that its proposal is fair and equitable, and
should be adopted by the Arbitration Board. The AAPSIC will present evidence in support of this
proposal in its case-in-chief at the hearing.
