Looks like the liberty ties paid off big time!  From the AAPSIC page 71 brief:
 
The Ninth Circuit’s holding, that the denial of the Nicolau Award in Paragraph 10.h. of the
MOU breached USAPA’s duty of fair representation, is effectively the tie-breaker on this question.
With the Ninth Circuit’s affirmation of the West Pilots’ reasonable expectation of the Nicolau Award,
the AASPIC acknowledges it as the starting point for ranking the East and West Pilots on the ISL.
As part of the ISL, the US Airways Pilots (East and West) should be ordered based on the Nicolau
Award.

The West is in a dizzy tizzy over proposals? Hysteria and lunacy from all three groups (but especially the West) will have their brief walk in the sun but a "fair and equitable" award will be the boa answer. The boa arbs don't have hysterical emotions. They don't have the ties for it.
 
Interesting that the AA proposed list managed to push me downward another 500 numbers since their last proposal. They only allowed 45 of the 180 East Group IV captain positions to be integrated with the full complement of AA positions. All of which are retired at this point effectively giving them 100% of the Group IV captain positions once the ISL is finalized and no consideration whatsoever for the US Airways A350s on order.

The courts and the arbitrators "get it", agreed.

12” We decline to order the issuance of the West Pilots’ requested injunction
“that an unmodified Nicolau Award must be used to order the seniority of the East
and West pilots in the pending McCaskill-Bond process.”

“4 While enjoining the USAPA Merger Committee from participating in the McCaskill-
Bond seniority integration arbitration, except to the extent that it advocates the Nicolau
Award, the Addington majority recognized that, given the requirement of a ratification
vote by all pilots for any joint collective bargaining agreement, it was unclear whether the
Nicolau Award would have been implemented fully but for USAPA’s actions. Further,
the court expressly declined to order that an unmodified Nicolau Award be used to order
the seniority of the East and West pilots in the arbitration.”

Say whatever you want...but the Nic award IS fair and equitable. You East guys are literally the ONLY group to have EVER suggested it isn't. That should tip you off.

Frankly, that's a shame. Dave O'Dell should be stapled. The Dead beat never donated a single dime to AOL for his defense. That's pathetic and it's hardly gone unnoticed.

Maybe they can put a fence around the MD80's so they won't be in consideration either. The flight deck looks like it was designed by John Deere  😉
 
 
It looks like JA is in a very bad MOOD using caps on the C&R's. He's having a bad weekend, his USF Bulls lost again and his other team, USAPA is running out of time-outs. And to see the grief (or is it Greif) in the stands....AWE
