If one has done so by actually EARNING it, then yes, most fitting indeed.

Given the track record to the Nouveau East I'd say you more appropriately squandered what the generation that preceded you built. You stared down bankruptcy by crapping your pants and giving away your pension and lapping up LOA93, destroying in a few short months what it took you predecessors years to build. "Living to fight another day" you decided to aim for a softer target, your fellow pilots. Perhaps you should call your mighty squadron of pitiful pilots the "Laugh-at-Us Escadrille"

Perhaps the only one not encouraging your prompt retirement is you.

Unlike yourself: I know what a mighty squadron actually is, and you wouldn't have done us any good as so much as a chock methinks. As for this little labor squabble...Well....Run along now, and go back to your fellow little "spartans" in your...umm..."army" in Fantasyland. 😉 As for squadrons; a few of us are getting together in January. Is there any chance you could perhaps send me a few toy spartans, or even T-shirts so I can hugely impress old comrades with my new-found "coworkers" and "associates"? 😉

Since the west pilots have been materially harmed, an amount of harm that can be measured, why hasn't the west sued USAPA for their actions? Look like this deliberate act on behalf of USAPA, is, well, "ripe" ??

If that has happened, it hasn't made it into this thread.... Or, I've missed it because I only drop in on ocassion..

How,s that TWA pilot thing goin , they have been harmed by APA, or did we miss it! We know it is tough holding a seniurity number at FRANK AIR and AA!

TWA waived their LPP's. They have sued APA repeatedly , and lost. They've sued ALPA and won.

And that is the important point these east clowns miss.
The TWA MEC was the responsible party in screwing the TWA pilots, hence the reason the APA has not been successfully sued but ALPA has.

Now, if USAPA decides to change the seniority list to benefit the east guys they (USAPA) will be the responsible party and they (USAPA) will be successfully sued once a contract is ratified.

Checkmate girls!

Good question. The district court recognized harm and a jury agreed, USAPA was sued with an injunction. The 9th Circuit Appeals overturned the issue on ripeness, saying there was no harm since a contract was not actually ratified. Once a contract containing DOH was ratified by the pilot group, the west will have a ripe claim.

Almost four years later USAPA has not been able to produce a contract, negotiations are parked and Parker stated last week they shouldn't resume because the seniority issue is not resolved by USAPA. Basically, the company isn't negotiating seniority with USAPA since they are also a liable party... The east clowns don't get this... But you can't fix stupid and that's why we are now in a terminal loop.

Good question, and the judges are divided on this issue. Wake (district) and Bybee (Appeals- dissenting opinion) agree with you, the other two on the appeals court do not. Reality is, you are correct that harm is being done. But eventually it will be rectified with a joint contract, the soonest would be a contract through APA. Our seniority is secured in the meantime and the west is patiently waiting this out because the east controls the union and the tempo (which is why there is no contract five years after USAPA- they are incapable of even accomplishing menial tasks because of all their infighting out east).
LIfe is too short to get wrapped around the axle because of the trailer park crowd out east.
