If usapa and the east is winning and now think you can do whatever you want with a seniority list, go do it. Why all of the begging for compromise? Just go do it. Get Parker to agree to whatever you think is fair outside of the Nicolau and we can let a court decide if what you did represented the west fairly or not. Stop talking about it and get it done.

Let's see what kind of skills usapa and east pilots have.
 
When Silver dismisses this, hopefully the NMB will finally see that legal resolution is not forthcoming, and will open the door again for negotiations. Despite respective east and west camps and their associated bloviations, that's not where the circle jerk really is. The true circle jerk is in the legal and political arena.

I hope the NMB opens up the negotiations again so we can get this show on the road.
 
You have got to be massively pi$$ed at Leonidas and their advice not to take the recalls. AA looming, massive East hiring ramping. How do you handle being on the street, when there are new hires east going on top of you?

Unlike most of you guys, I've never been in the street. And once Nic kicks in, we'll all fall into our fair places.

Agreed in full LS, although I'm uncertain what/when/how/etc will be effected by the possible American merger. With no personal prophesies to offer; it's certainly possible that would effectively play the part of a deus ex machina, that would change much of the current mess around pretty quickly....to what end must remain anyone's guess at present.

Whether some agreed seniority could be established with the APA without arbitration, or what type list(s) would be forwarded for such seems to yet be up in the air.

Not sure where you're getting this dismisses crap from, but that's not going to happen. She's merely going to tell the company to do what they have to do and see what happens.

What is the problem boys? You guys figuring out that what judge Silver did and what the union told you are two different things? That by dismissing because of ripeness it does not get you any closer to slithering out of the arbitration.

What did she do? Is her ruling out?

"hopefully the NMB" Not a very solid strategy for moving the pilots group forward. Is that the best usapa has hopefully?

What has changed from June 2010 to today legally? what reason would the NMB have for opening negotiations again? What possible reason would the company have for wanting to talk about seniority? Read the transcripts. The company does not want to negotiate for seniority especially without immunity.

Once again I ask. What is usapa's plan B? What is usapa plan if the NMB refuses to "hopefully" open negotiates again? Are they going to sue the NMB for not bowing to the mighty power of the majority usapa?

Will we become APA before usapa can even propose their version of a seniority list?

I agree with you. Most west pilots I know are completely confident that you would win DFR II, so it seems like they would be anxious to get there.

Get to it. This is in usapa's court. Time to perform. After 4 years of failure I want to see some movement. Present that proposal and get an answer from the company.

With Silver proposing to dismiss the Company's prayer for relief without answering any of the questions which she was asked to, there is only one likely way for negotiations to resume. It's the same option that has been there from day one ...USAPA has to accept the NIC for S22 and move on. If USAPA does this negotiations will resume; if they don't the NMB will likely keep the parties parked. Thus is looks like the jury from judge Wake's courtroom based on the merits of the DFR case against USAPA may just be the only definitive answer to the question regarding a successor union's responsibilities to perform under the terms of the contracts it inherited. An unquestionably ripe JCBA using a Non-NIC list has almost no chance of ever coming into existence.
