Here we are 11 days after the PBGC filed their report with the court. Yet still no update from the pension committee. Are they ignoring the filing? Fingers in their ears chanting no,no,no?

Where is this secret document that they were going to send out that would prove the single bullet theory that someone was going to jail and huge checks were on the way?

We will release it to the pilot group, we promise. We cannot release it to the general public until we have exhausted the agencies to which we’ve brought it to.

If the NMB leaves usapa parked..why would the company appeal?

I mean how much clearer can the courts make it.....use a non-Nic and then we will decide the damages total on the DFR. Oh, and BTW, you have given testimony that makes it clear you understand the issues perfectly.

I would say in the event of a merger, look to a Nic derived SLI with the APA. or, sans merger, look for increasing pressure on the West to capitulate on the Nic to reach a concessionary contract.

Pi also dismisses the entire issue by stating that the company was merely found guilty of violating West min block because they decided to calculate it differently. Well...that is another example of the collusion. They decide to furlough, so they decide to calculate West min block in a different manner than how they decide to calculate east mins, while moving flying east and disproportionately furloughing West.

The company filed a DJ asking for answer! They have made no reply to USAPA on section 22 for 5 years. On what planet can that be collusion? Did USAPA eagerly go along with the delay in getting a contract? Was the NY filing and the whole onboard/injunction a giant, clever ruse? I think not.

The company has simply taken advantage of our collective stupidity. They may be sweating it now, if it threatens an AA merger.

I believe that you are omitting the legal construct of "tacit collusion" from your seniority paradigm. There are some interesting papers published in the National Law Journals and other sources that might enhance one's understanding of the issue.
Furthermore, the "stupidity" of which you speak is most definitely NOT collective. That distinction belongs solely to USAPA and their supporters. Both the company and AOL have maintained a precise appraisal of their situation, as evidenced by the company's stated position in the recent DJ. I highly recommend that everyone read the transcripts for themselves, instead of relying on non-contextual snippets, in order to avoid a "fatally" flawed perspective of events, which only furthers our impasse.
And finally; Yes, USAPA "eagerly went along with the delay in getting a contract"; Of course, the company made no reply to USAPA on section 22; No, they weren't a ruse, they were at best, ill advised. But the real questions are: Why did each individual party pursue it's course of action?, What were the results? What benefit did each party stand to gain vs cost? Will they mitigate those positions over time?

The responsibility for the quagmire that we find ourselves in belongs solely to the East and to the Company. Consequently, they are the only parties that can move us forward.

You are making a huge assumption when we do not know the facts.

First, usapa was elected and went to the bargaining table with a DOH proposal...we have no idea what the company's response was other than they did not accept the DOH proposal. We have no other clues except that during the UA merger Cleary ran to the 9th asking for an emergency decision after a meeting in Tempe, that company officers have been coming to crew news visits for years trying to dissuade the West from seeking the Nic and suing, and that the CEO's tune toward the chain of events has changed over time.

usapa absolutely went along with contract delay.....forcing that BS LOA93 arbitration, taking advantage of the disproportionate furloughing.

The NYC case and the on board actions were more of the same ignorance that is usapa. It all boils down to fight the NIc for usapa. Every decision made in the past 5 years has been to the end of avoiding the NIc and/or a tentative agreement that contains the NIc. There is sufficient evidence that says the company would like to get itself out from under the pressure usapa puts on the company with all these stupid misconstrued ideas of their actual situation, so the easy thing to do would be appease usapa and pressure the West.
