Given that Parker wants a merger to be part of AA's POR, there are a few problems with your theory.

USAPA's C&B/Ls require DOH so what does USAPA do for negotiating/mediating, arbitrating the west list? DOH? Nic? Either way an "unquestionably ripe" DFR suit follows. The company, by being complicit with USAPA in using 3 lists (remember, the company has stated in court that US/AWA seniority was settled in 2007), gets involved in a hybrid DFR suit. So the merger would be on hold till the court cases were finished. That means AA's unsecured creditors wouldn't get paid until the court cases were finished and they wouldn't like that compared to an AA stand-alone plan. So a "3-way" effectively kills any merger on Parker's terms but leaves a reorganized AA free to buy US after all the legal issues are settled. Then there's the APA - they're supporting Parker's vision of a merger and expecting a bigger paycheck to go with the merger. Are they willing to wait years for the merger to happen?

Of course it was long after 2007 that Mr. Parker said his attorneys think it will be a 3 way. Based on the latest course of events, I think we can say that the company incorrectly stated that the seniority issue way settled in 2007. It happens.

Indeed. Perhaps the most incredibly grandiose and self-serving west fantasy of all is that a merger with American woud be magically thwarted by the mere threat of litigation involving...gasp!...pilot seniority squabbles! That anyone, anywhere could even momentarily believe that to be a real possibility is honestly a bit disturbing, and one must have some real concern for the state of their emotional and mental health.
 
I don't know about the rest of you but the next I just can't wait for the next road show, will it be at PHX or CLT. If PHX better bring some cheese and crackers the westies will supply plenty of whine.
 
We are starting to hear that not to many people are giving money anymore to AOL, they are broke and in debt to the attorneys,and feel they have been mislead and lied to by Furguson (go figure). The implosion has started.

Not so sure... Move is now the single largest contributor to AOL... Can afford to be now that he won't be moving.
