Like actually upgrading when your seniority number comes up? No? Oh, that's right, that floating "gold standard" which was good enough for Piedmont and PSA but not good enough for Empire or Trump but good enough again for AWA. God you clowns are comical, just like weather vanes. Ever wonder why you are still on LOA 93? Forget it- you're not going to understand it even if you read it in a picture book.

What was your place in line to upgrade sweetness? When were you hired at AWA? Had you upgraded prior to the MERGER? Where are you now? Just want to make sure we are on the same page.

I've no argument with that. I've a serious argument against said "seniority" number being whimsiacally determined by some Wheel of Fortune spin. Here's an apparently radical thought for your consideration: How about actually upgrading when you've worked for it longer than the next person in line? Or...was all that noble sounding: "Others do not have that same ability to walk the tough road and earn things....." just pure, 100%, complete and unadulterated BS? 😉

Junior is special, oh the pride in having such a prodigy, even if pops had to manufacture it himself. Kind of like a plastic model kit that doesn't need glue- just snap together and presto! PIB "the wonder kid"

Well, I earned my job. RJ captain, 121 jet PIC, stuff you probably would have trouble relating to. But, like everything in life, reality has a way of catching up to us in life. Oh to be a wonder kid... Tell us, what is it like?

Paid for most of my flying and college by working as a lineboy since the age of 15 and taking out loans. Station managers at PI weren't exactly getting rich and my sister was in nursing school. My parents helped me with what they could and I drove a car that my cousin loaned me for a while. While you were letting boys diddle you in the back seats , I was fueling and dumping the lavs on 737s and 727s. Anything else?

You were a captain? That's really scary.

You didn't answer the questions. Exactly how did you "earn" your job? RJ captain. Really? You start there?

Again. What year did you start with AWA? When did you check out as captain at AWA?

Lets make this easy for you...

You don't believe USAPA is sincere in their overtures to the the West regarding the opportunity to discuss the seniority list... You don't believe USAPA really desires any change to the list. i.e.. USAPA (according to you) doesn't have any sincere intention to negotiate with the West about it.

On other hand, Marty is making proposals about the list, i.e. MARTY IS NEGOTIATING, albeit without much success. Why are several West posters bouncing up and down with glee that the East is begging the West to accept a change to the list, when it is obvious that is not the case, and you are actually arguing the opposite?

Do you have a reading comprehension problem? Marty is NOT negotiating. He told usapa in no uncertain terms no negotiating.

Your letter to me (and a very similar letter recently sent by President Gary Hummel to
John Scherff) asks the West Pilots to negotiate. Yet, there is not a lot to negotiate because
USAPA insists it will never implement the Nicolau Award. Any date-of-hire seniority list
(whatever conditions and restrictions it may have) is unacceptable. Implementation of any such
seniority list would be a DFR breach. As I’m sure you know, neither John Scherff nor any group
of West Pilots can waive an individual pilot’s claim arising from such breach. At best, such
“negotiations” can only create a false appearance of fair representation. Our clients will have no
part of that.

What part of our clients will have no part of that do you not understand?

The time has come for USAPA and the East Pilots to be fully and fairly informed about
the status of the Nicolau Award and the significant risk USAPA runs if it deviates from that
Award without legal justification. We understand that the leadership of USAPA and others,
perhaps even including yourself, have been telling the East Pilots that USAPA is now free to
either use or propose any seniority list it wants. Those statements are not true and it is time that
USAPA and the East Pilots fully understand this.

The parties to the Transition Agreement agreed in advance that the Nicolau Award would
be the final resolution of the seniority dispute. USAPA can deviate from the Nicolau Award if,
and only if, the deviation is “supported by a legitimate union purpose.” USAPA has now had
almost 50 months of litigation to propose a “legitimate union purpose” for deviating from the
Nicolau Award. The reasons proposed by USAPA in the Addington trial were rejected by a civil
jury. In the current US Airways, Inc. litigation, USAPA failed to come forward with an argument
that was acceptable to Judge Silver for deviating from the Nicolau Award. The reason for
USAPA’s failure is that there is no “legitimate union purpose” for deviating from the Nicolau
Award. There never has been and there never will be.

This in fact is the current state of affairs and USAPA and the East Pilots need to
understand that. This will pose grave problems for USAPA when it restarts negotiations with US
Airways pursuant to Section 6 of the RLA. It will also be a looming problem for USAPA if the
merger with American Airlines is concluded and the overall pilot seniority integration issue is
resolved through a McCaskill-Bond arbitration. In either scenario, USAPA must use the Nicolau
Award unless deviating from the Award is “supported by a legitimate union purpose.” That
appears to be an impossibility.

There is nothing in these letters that even hint that the west wants to or will negotiate. It is the east that is screaning talk to us. Not the west.

Just so you understand this. there is no need to talk to usapa because we would not be negotiating seniority. usapa is C&BL mandated to use DOH so the only thing we would negotiate is C&R. I have told you several times there are no C&R in the world that makes DOH fair or equal for the west. So it is a waste of time to even talk to the begging usapa.
 
Scherff should be in jail for the leaking of social security numbers. Instead you elect the criminal element to union positions. Nice, just like Franke would have it. A nice little criminal enterprise. At least Mike Cleary could pass a background check. Scherff is a bona fide criminal operative.

Marty made a proposal about the list and asked USAPA to adopt his proposal. That is an attempt at negotiating. I don't blame him for trying.
