Same date, another AP article brain surgeon. I do like this, because it backs up what I've said about AWA being the template for LOA 93:

"The airline has said it needs a cost structure in line with those at low-fare carriers such as JetBlue and America West Holdings if it is to successfully compete. "

Keep digging AW. Let's see what else you can find. Maybe a few about AWA's 2004 loss? I've got the links if you need them.
 
That is my point. It's rare, if ever that it happens. The airline business has it's ups and downs and one's career shouldn't be measure at one time. The Nicolau award was composed at our lowest point. He didn't look at the rapid movement that would come on a static list. He bought the liquidation argument, even though we didn't liquidate. That our assets were there going forward and he shifted much of the benefit to the west.

You didn't answer the second, so I'm guessing that you weren't. How would you liked if AWA had gone back into Ch 11 and another company came in, took advantage of that and you were locked into your lowest point in your career, just before those ahead of you were about to retire?
I didn't answer the question because I don't offer up personal situation information as it would have no bearing whatsoever on my opinion of this dispute. I don't worry in the least about what other people may or may not have in relation to me. If I can command more money or status working for some other company I might switch, but I'm not going to be bemoan my lot in life as if someone else has control over my contentment and happiness. No one ever said life had to be fair and in my opinion Nicolau gave the east way more than he had to and way more than he gave the west in his attempt to make things fair for the east even though they were at an exceeding low point with a company that was teetering on the edge of liquidation.

Thanks for making the argument against the east pilot "generous offer" for the west to "just wait 5 years". No thanks as you made the point up and downs. 5 years from who knows what would happen. Another merger and guess what , wait another 5 years boys sorry. You know how that works right?

As to your other point at least you are now admitting that 2005 was your lowest point. That is when mergers get done. When one airline is weak, dead, or about to liquidate. So to bad so sad your airline was almost dead. The arbitrator decided that saving your career with a merger and getting 90% of the new contract was going to be offset by seniority. Just like the dispatchers got offset because the west dispatchers were going to get a big raise.

Go ask Roland Wilder about going onto a merger with a bad contract and what an arbitrator does to balance seniority.

I know you don't like. Again to bad. I know you think you were about to gain all this attrition. Without the merger you would have 100% attrition. America West was the one and only chance for US Airways to come out of BK. A merger saved your jobs. (notice I did not say we saved your jobs)

So looking at the usapa C&BL your un merged career expectation was liquidation and starting at the bottom of another airline list if you could even get a job. So in reality according to the usapa C&BL the C&R should work to staple the east to the bottom of the west list. That was your un merged career.

Nicolau did not staple you. He gave you much more than that. Just because it is not what you think it should be is not a LUP.
 
I, boo boo, have done nothing regarding this list. WE have our lists merged via an arbitration process WE both agreed to. The ARBITRATOR the WE both AGREED on used facts presented by both your side and my side which include career expectations sans a merger. That means that Nicolau extrapolated the chances of you liquidating as being nearly 100% and that's easily confirmed by pulling up various documents/reports off of the internet.

So I don't feel the entitlement you do. You think that this new list should have fixed your miserable career and you're pissed because it didn't. So if anyone is feeling entitled, its you boo boo.

The process was mutually agreed to as was the choice of arbitrator who saw fit to slot us in the fairest way.

Now, bang away.
