Judge Silver said it in her ruling.
Not a lie just the facts.
Show us the quote where she said USPA had to use ALPA merger policy, specifically the Nicolau.

The 40-60 is what the east gets the west gets a lot less.
Try again.

So, you agree fairness is subjective?
OK, show us where she said it will be held up against the Nicolau. You are the ones with the vivid imaginations about the Nicolau. You might think you have a shrine to it in your homes.Boy you guys are dense. She didn't say USAPA has to use the Nicolau, but whatever USAPA presents will be held up to the Nicolau. Kind of think of it like contract negotiations when you're dealing with a set amount the company can afford. You can increase the pay and decrease the benefits or vice versa, but the end product is the same. You might (it's a big might), be able to disadvantage the junior AWA FO's to the benefit of the senior AWA guys or vice versa, but the end product will be held up to the Nic. Mr. Parker and the legal team know this, how many more years is it going to take you to figure it out?

If it gave ALL of us second thoughts about how we treat each other then that SHOULD be the standard. I would have given more time to lapse before I would have brought a suit but it is what it is.Does that standard also apply to false accusation of RICO and is theft?
Subjective, anyone can be sued, as the CACTUS 18!This is what she said:
Of course, in negotiating for a particular seniority regime, USAPA must not breach
its duty of fair representation. Accordingly, if USAPA wishes to abandon the Nicolau Award
and accept the consequences of this course of action, it is free to do so. By discarding the
result of a valid arbitration and negotiating for a different seniority regime, USAPA is
running the risk that it will be sued by the disadvantaged pilots when the new collective
bargaining agreement is finalized.
An impartial arbitrator’s decision regarding an appropriate method of seniority integration is powerful evidence of a fair result. Discarding the Nicolau Award places USAPA on dangerous ground.
Nope. I agree PHX is subjective. Enjoy the place while it lasts at even it's present level of staffing and flights.
It's a true pity that any of this entire mess ever came to be...but I've no real sympathy for greedy and self obsessed people.
"It's ALL about MEEE!" is truly the root source of evil in this world. Enjoy all the grand "benefits" of embracing that "philosophy" and good luck with all to come.

Dicta, dicta. dicta, etc., etc., etc.
