He probably has bigger problems to worry about with a possible furlough. Do you notice how he ignores the big ticket item which may directly affect him (furlough injunction) but he is so doped up on thoughts of having a few west pilots terminated because they refuse to submit to blackmail it monopolizes his posts. Maybe he thinks message boards are totally anonymous but words do follow you, and I truly am shocked he is giddy over having even EAST pilots terminated. It is truly an insight into a bitter and twisted mind, and even more it demonstrates the character of the USAPA followers. Now we know why we are where we are... the east is chocked full of a bunch of machtucks. Thank god we have a honest legal system to hear our case.

You guys out west are facing a serious issue which you will not be able to sidestep...and all you can do is toss out that I may get furloughed.

Each person who does not abide by the laws governing this airline and it's union are going to be dealt with...East or West. Not my problem...also should come as no surprise to any of you.

It is your feet that you follow...and your choice.

Then why do post so often about it if it isn't your problem? All I am pointing out is you have your own set of problems like facing possible furlough yet you are so fixated on this witch hunt against the west. Bitter seeds indeed sir.

And if you keep ignoring me as you have claimed four or five times around here, why do you keep attacking me?

Amusing rhetoric indeed. Early on in the BS, the west are "loyal pilots", but almost immediately after are rendered into nothing but a helpless child...and you feel the phraseology wasn't both patronizing to your group and generally laughable overall? ...Hokay then.

I won't even waste time addressing the absurdly slanted and useful-for-domestic-propoganda-only character the piece had, save to note: "and won't let this injustice continue"..Well...Whoever wrote that tripe fully knows where and how to push your happy customer buttons out there..That could have been taken directly from any number of posters on these boards, as could much of the overall BS as well. Does anyone know the current status of lawsuit against ALPA for the active pilots (MDA) who were considered furloughed by Nicolau?

No, but LOA 91 or 93 clearly stated that a pilot had to be furloughed from mainline to fly for MDA. Additionally, those furloughed pilots needed to be recalled to mainline. It will be a hard case to prove, given the fact that those flying for MDA were shown on the APL (affected pilots list) and CEL (combined eligibility list), but listed as furloughed on the mainline list, until the merger was announced.

You left out the part about MDA not being a seperate certificate...it was USAirways' certificate.
You left out that the training, manuals, paychecks, scheduling, and FA's were all USAirways..

Since we're on the subject of MDA, here is a couple of questions that I don't recall the answer for:

1) As pilots were furloughed from mainline, where would they go at MDA? Did the juniormost pilot at mainline go to the seniormost position at MDA (as the seniormost captain)? It would seem that would cause a continous flow of training/downgrades as newly arriving "captains" would force earlier arriving captains down the list and into fo positions.

2) If a pilot was furloughed at mainline and did not wish to go to MDA (found a job at JB?), did they simply accept a furlough or did they need to request an LOA from the airline?

3) If a pilot coming up on his furlough number did absolutely nothing....did he automatically get transferred to MDA or did he get furloughed?

4) Didn't MDA also hire "off the street"? How were these guys integrated into the mix as furloughed pilots from mainline were also coming to MDA?

1) No, the first off the "mainline" to the "division" (same certificate) would go as CA if they were qualified...and they were (ATP) to be typed. As to the "resultant seniority" I don't know, I wasn't there.

2)FUR pilots went wherever they could find work after 9/11...It took me 16 months to find a flying job...(Mesa finally signed a J4J deal)..nobody else would touch a major furloughee as "we'd leave ASAP"
3)He got FUR...

4) MDA offered every FUR mainline pilot a spot...I got the letter too...it said "...this is your first step back to the property..." (even though it was ON the property to everyone but the company and ALPA) When they got a poor response ( I declined because I smelled a company/ALPA skunk) they hired from the street to both seats...got a LOT of takers from ALG and PDT..they are all on the CEL list now.

ALPA is going to lose this lawsuit, that's why they're dragging it out.

The LOS that the FUR mainline pilots had there should not have been ignored by NIC.
 
It's a nice Press Release, well written, no typos that I found designed to make the folks who have funded the lawsuit feel good about parting with a few thousand dollars and to garner negative media attention in an effort to negatively impact stock price.

Anyone know the status of the request? Hearing date? any ruling yet? Etc etc??

Piney, the State Court action got tossed today without a hearing. No juristiction. Driving down the price of the stock. But hey, what do they care? snooper
